Peas supply the following information;

1. On what premises are Craven Council's Summons for non payment of council tax printed? A) At a HMCS Court building (Please state address) or B) Craven District Council's own building, or C) Elsewhere/Not known (Please provide details).

2. If Craven Council print the summons on their own premises or have them printed by any other body than the court, what legislation, act, statute or law are they relying on to ensure that this practice is lawful and correct?

2B What is the cost of printing the Council Tax summons?

3. Who does the signature on the Summons relate to, what is the true name of the signatory and what is their position in the Council or Court?

4. What fee does the Council pay the Court for every summons issued?
4b when the fee is paid in the form of cots by the defendant, can the defendant obtain a receipt directly from the Court?

5. Is the person referred to in Council correspondence regarding Council Tax as a 'Council Court Officer' employed by the Court or the Council?

6. What is the Court's role in dealing with the matter of Unpaid Council Tax from the point where the summons is issued? Please provide a step by step breakdown of the way the matter is brought before the court, up until the point a liability order is issued?

The Council Tax (Administration and Enforcement) Regulations 1992

 

2B What is the cost of printing the Council Tax summons?

Approximately £0.43 per summons

 

3. Who does the signature on the Summons relate to, what is the true name
of the signatory and what is their position in the Council or Court?

AC Gardener, Deputy Justices Clerk, North Yorkshire

 

4. What fee does the Council pay the Court for every summons issued?

£3.00

 

4b when the fee is paid in the form of cots by the defendant, can the
defendant obtain a receipt directly from the Court?

Court does not accept payment.

 

5. Is the person referred to in Council correspondence regarding Council
Tax as a  'Council Court Officer' employed by the Court or the Council? 

Council.

 

6. What is the Court's role in dealing with the matter of Unpaid Council
Tax from the point where the summons is issued?   Please provide a step by
step breakdown of the way the matter is brought before the court, up until
the point a liability order is issued?

I suggest that Court procedure is a matter for the Court to respond to.
