I have searched the Commission’s records and can confirm that we hold some
of the information requested and have attached the results found to this
email.

The Commission does not hold any records of concerns raised about the
running of the Easton Community Centre within the last 60 months.

The Commission holds records of correspondence during the registration of
the charity in 2013 and this is attached to this email.

The Commission has records of phone calls made to the Commission on 15
January 2014, 26 November 2013 and 4 April 2013.  These are recorded as
General Enquiries and no notes have been made of the content of the
calls.  In accordance with our data retention policy recordings of the
phone calls to the Commission are deleted three months after they are
made.

I have removed some information from the documents provided as I consider
this to be exempt from disclosure under the Freedom of Information Act for
the following reasons:

 

Section 40 (2)

Personal information is withheld under Section 40(2) of the Act, as the
information constitutes third party personal data for the purposes of the
Data Protection Act 1998 (DPA). Section 40 (2) provides that personal data
about third parties is exempt information if one of the conditions set out
in section (3) is satisfied, namely whether any of the data protection
principles would be contravened by the disclosure.

Under the Act, disclosure of this information would breach the fair
processing principle contained in the DPA where it would be unfair to that
person and/or is confidential.

 

Section 41

You will also see that I have removed all references regarding the
charity’s bank details, as we consider that this is confidential
information. As such the exemption under Section 41 of the Act is engaged
as we consider the information confidential. This is because it refers to
information obtained from other parties and where disclosure would breach
our duty of confidence, and would be potentially actionable by those who
supplied it. This is an absolute exemption by virtue of section 2 (3) (f)
and (g) of the Act and no public interest test need be applied.

 

If you think our decision is wrong, you can ask for it to be reviewed.
Such requests should be submitted within three months of the date of our
response and should be addressed to the Charity Commission at PO Box 1227,
