Thank you for your request received on 15 October 2012 requesting
information about Healthwatch.
Request:
Follow on from FOI 5034;
Could I please have the contract for the current year, 2012/13. This
should make provision for services to Healthwatch as well as LINk.
 
 
Response:
This is the current contract (already released to you under FOI 5034). 
The, original term was 2008-2011 but had option to extend up to a further
2 years which has been used to 31/3/13. Extract from contract below.
Term
2.1      The Agreement shall take effect on the Commencement Date and
shall, subject to clause 2.2, expire automatically on 30^th September
2011, unless it is otherwise terminated in accordance with the Agreement,
or otherwise lawfully terminated.
2.2      The Authority may seek to extend the duration of the Agreement in
accordance with clause 48.  During the Extension, the obligations under
the Agreement shall continue (subject to any Variation) or adjustment to
the Price pursuant to clause 24 until the expiry of the period specified
in accordance with clause 48.
 
Possible Extension of Term
48.1      Subject to satisfactory performance by the Contractor during the
Term, the Authority may wish to extend the Agreement for a further period
of up to two year(s).  The Authority may approach the Contractor if it
wishes to do so before the end of the Term.  The clauses in the Agreement
will apply throughout any such extended period unless otherwise stated to
the contrary.
This is the contract with Shaw Trust providing support to both Suffolk
LINk and the developing Healthwatch provision.

Thank you for the reply. The 2008/11 contract allowed for possible extension. You say that an extension was actually agreed up to 31/3/2013. This must have been recorded in writing and covers the period of my request. Would you please send this. Any arrangement for Healthwatch would fall outside the terms of 2008/11 because it did not at that time exist and it is not a part of LINk.It would therefore require an additional agreement.

We have agreed that the contract be extended for the year 2012/13, with Shaw Trust providing support to both Suffolk LINk and the developing Healthwatch provision, supporting the transition. We attach the revised service specification which Shaw Trust have agreed. The contract will conclude on 31st March, 2013.

I am writing with regard to your request under the Freedom of Information
Act 2000 (the Act) to this Council (Our Ref.: 5102) which resulted in you
being dissatisfied with the outcome, as below:
 
Thank you for your reply. I am sorry for the delay in responding as I
have been away for a month without email. The document attached relates
to 2011/12, not 2012/13 as stated. It also lacks all information about

I have looked into this matter with the Directorate concerned - Adult and
Community Services.
 
It was confirmed to you on 22 October that the original contract had been
extended and a copy of the letter to that effect was supplied. This made
provision for 2012-2013 and was an extension of the contract supplied to
you under your previous request - 5034. This included the 'payment and
price' schedule on which the extension was based.
 
What Adult and Community Services did not provide originally was a copy of
an e-mail which was issued regarding the extension, the text of which was
as follows:

posts have been advertised internally so that progress towards appointment
may be made as soon as possible. You will realise that it is vital that
the Local Healthwatch workstream is progressed as soon as possible, to
enable us to comply with implementation dates.

Thank you for your reply.

The letter sent to me on October 22 did not make provision for 2012/13 as you state. It said "The contract will now end no later than 31 March 2012". Nor did it include any "payment and price schedule"or other financial information. Please refer to the document you sent me.

The email of April 24 quotes a single amount for LINk and Healthwatch. Did the council agree separate amounts for services to the two organisations? If so please let me know what these were.

I refer to your e-mail below. Given the amount of correspondence I can
appreciate that there is scope for some confusion (on both sides). For
clarity, the e-mail sent to you on 22 October does state the following:

we have provided the required information to answer your requests. From
this Council's responses, including to the internal review, I cannot seen
that anything is now missing.

 

As I indicated in my previous communication, if you feel otherwise then
you are absolutely entitled to refer your concerns to the Information
Commissioner. Of course, if you have further information requirements then
we would be very happy to receive and to deal with those.
