Can you please provide all details of communications between West Kirby Football club and yourselves regarding any sale or/and proposed sale of land or lease of land , over the last decade? Thank you.

Dear Mr Barnes

Thank you for your recent request below which has been facilitated under
The Environmental Information Regulations 2004, (EIR).  For more
information on these regulations please follow this link

The Council considers that this information is exempt from disclosure in
accordance with the exception contained in regulation [2]12 5(f)(iii) to
the extent information has been provided to the Council where the
person(s) had not consented to its disclosure.

 

The public interest test, Regulation 12(2) of EIR provides that public
authorities should apply a presumption in favour of disclosure; however
the Council considers that disclosure of this information would affect the
free flow of information between the public and the Council.  I further
believe that disclosure may also impact on the public providing voluntary
information.  I consider the public interest in maintaining the exception
outweighs the public interest in disclosing the information. 

 

In addition to this, it is Council’s belief that individuals contained
within these communications would not have an expectation that this
information would be further disclosed.  This information amounts to
personal data and is covered by the exception in [3]Regulation 13(1) of
EIR.

Regulation 13(1) provides an absolute exemption (i.e. the public interest
test does not apply) for information about identifiable individuals were
this would breach the Data Protection Act 1998.   Personal data of third
parties can only be disclosed in accordance with the data protection
principles and shall not be further processed in any manner incompatible
with that purpose or those purposes; and shall not be processed unless at
least one of the conditions in [4]Schedule 2 of the Data Protection Act is
met. We consider that these individuals would have a legitimate
expectation that their personal data would not be further processed.

 

You have the right under Regulation 11 (1) of the EIR to make
representations to the Council, if you consider that the Council has
failed to comply with a requirement of the Regulations in relation to your
request. Any representations should be addressed in the first instance to

You also have the right to complain to the Information Commissioner

made representations first.
