Dear Greenwich Borough Council,

I would like to request details on details on housing/TA placements made into the Borough of Slough. S208 of the Housing Act 1996 sets out that ‘so far as reasonably practicable a local housing authority shall in discharging their housing functions under this Part secure that accommodation is available for the occupation of the applicant in their district.’
Where accommodation is secured outside of their district, the placing council needs to give notice to the local authority where the accommodation is located. We are aware of a large number of placements in Slough, as we are contacted by colleagues in Education and Social Care departments regarding such placements, yet the number of S208s received is relatively low. In accordance with S208, we would like to request the complete number of current placements that you have in the Slough area,
• the name of the applicant,
• the number and description of other persons who normally reside with him as a member of his family or might reasonably be expected to reside with him,
• the address of the accommodation,
• the date on which the accommodation was made available to the household, and
• which function under this Part the authority was discharging in securing that the accommodation is available for his occupation, e.g., S188, S193, etc.,

We would request that the information is sent back on an excel spreadsheet.
Thanking you in anticipation of your help

Jack Dempsey

Dear Mr Dempsey,

FOI request: FOI-2669

Thank you for your request dated 30/09/2024

Our response is as follows:

I would like to request details on details on housing/TA placements made
into the Borough of Slough. S208 of the Housing Act 1996 sets out that ‘so
far as reasonably practicable a local housing authority shall in
discharging their housing functions under this Part secure that
accommodation is available for the occupation of the applicant in their
district.’

Where accommodation is secured outside of their district, the placing
council needs to give notice to the local authority where the
accommodation is located. We are aware of a large number of placements in
Slough, as we are contacted by colleagues in Education and Social Care
departments regarding such placements, yet the number of S208s received is
relatively low.

In accordance with S208, we would like to request the complete number of
current placements that you have in the Slough area,

•       the name of the applicant,

•       the number and description of other persons who normally reside
with him as a member of his family or might reasonably be expected to
reside with him,

•       the address of the accommodation,

•       the date on which the accommodation was made available to the
household, and

•       which function under this Part the authority was discharging in
securing that the accommodation is available for his occupation, e.g.,
S188, S193, etc.,

We confirm that we hold the number of current placements in the Slough
area, the name of the applicant(s), the number and description of other
persons who reside with the applicant(s), the address of the
accommodation, the date the accommodation was made available and which
function was applied when securing the accommodation.  However, this
information is being withheld in accordance with section 40(2) of the
Freedom of Information Act 2000 (the Act), as the information constitutes
third party data.  Section 40(2) provides that personal data about third
parties is exempt information if one of the conditions set out in section
40(3) is satisfied.  Under the Act disclosure of this information would
breach the fair processing principle contained in the Data Protection Act
2018, where it would be unfair to the applicant(s) if we were to disclose
this information without their consent.  Also, there is a reasonable
expectation from the applicant(s) that this information would be
confidential.

If you have any queries about this correspondence, please contact me,
quoting the reference number above.

If you are not satisfied with our response to your request, you can ask
for an Internal Review.  Internal review requests must be submitted within
two months of the date of receipt of the response to your original
request.  If you wish to do this, please contact us in writing, setting
out why you are dissatisfied.

If you are not satisfied with the outcome of the Internal Review, you may
apply directly to the Information Commissioner (ICO) for a decision.
Generally, the ICO cannot make a decision unless you have exhausted the
Internal Review procedure provided by the Council. You can contact the ICO
by emailing [1][email address], or by post at Customer Contact,

Dear Greenwich Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Greenwich Borough Council's handling of my FOI request 'Request of S208 placements into Slough Borough'.

We disagree with the refusal to provide the information and ask that you reread S208 as Slough have spoken to MHCLG HAST and they confirm that the information should be provided to be in accordance the Housing Act 1996. I would ask internally at Greenwich that you speak with Shaun Flook, AD of Housing who will advise of the correct procedure of sending the notifications and he will be able to confirm that I am Manager at Slough Borough Council and therefore can legitimately request the information.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/r...

Yours faithfully,

Jack Dempsey
