In Councillor Mears' public statement on the proposal to remove the cycle lane from The Drive she makes reference to "successive safety audits" of the facility backing up concerns over the safety of the facility.

Please supply me with copies of these Safety Audits in electronic document format.

5). We also used the Cycling England Professional Support Service to
review the scheme and their report is also attached - 2009-21-09 Brighton
The Drive Safety Audit Response.pdf.

I am writing to request an internal review of Brighton & Hove Council's handling of my FOI request 'Representations regarding the safety of The Drive Cycle Lane'.

I would like to know why it has taken four weeks to supply 5 copies of .pdf documents.

Additionally the documents provided do not include the Designer's responses to the Safety Audit Reports. These are an integral part of the Safety Audit and I would like to know why they haven't been provided.

Finally I would like to know what internal discussion/process took place as a background to Wendy Kassaman's enquiry 11 March 2011 regarding the continued validity of my FOI request. Please supply all relevant supporting documentation and correspondence.

Please can you update me on the status of your Internal Review of my FOI request. It is over a month since I requested it and I have not heard anything from you.

My understanding is that the Information Commissioners Office expects Internal Reviews to be conducted within 20 working days. Via the "What Do They Know" website please can you supply me with a copy of BHCC's policy and guidelines for Internal Review of FOI requests, including its date of implementation.

In direct response to your FOI appeal queries:

1. Council officers requested relevant correspondence from
Councillors in receipt of representations from local residents. A chase
on this information was made on 23rd March 2011 and no correspondence was
forthcoming.

2. Designer's responses to Safety Audits were not made in the
original FOI request and are not provided automatically.

3. Given the outcome of the budget meeting on 3rd March 2011
where all Councillors in opposition made an amendment to the proposed
budget which withdrew the proposal to remove Grand Avenue/The Drive cycle
lanes a member of the public who had also made an FOI request pending this
meeting withdrew their FOI request. At this stage the Compliance
Information Officer contacted those with outstanding FOI requests
regarding Grand Avenue/The Drive cycle lanes to ascertain whether they
wished to continue with their request.

I trust the above information answers your queries.

Dear Paul O'Neill,

I'm afraid your response does not answer my query. In reply to your points:

1) I made two separate FOI requests. Your comment regarding Councillor correspondence has no bearing on the Safety Audit request.

2) The Designer Responses are an integral part of the Safety Audit - they are not separate items (ref. DMRB HD19/03). I consider these items missing from my original FOI request.

3) Please can you clarify this point - was this the action of the Compliance Information Officer acting independently of any BHCC policy or procedure guideline?

If I have understood you correctly I have exhausted BHCC's internal review process and my only option is to ask the ICO for a review. Is that correct?
