Reported Hate-Crime/Racist Crimes

We're waiting for Scott Robinson to read recent responses and update the status.

Dear Humberside Police,

I’m writing to you under the Freedom of Information Act to request statistics on the number of hate crimes reported to your Constabulary. I’m building a study which details the changes in hate-crime behaviour in the last 10 years across the UK.

I want to know these three things:

1. The total number of reported hate-crimes in your Constabulary each year from January 1st 2009 to November 31st 2019.

2. From those cases above, how many resulted in a conviction?

3. Out of these hate-crimes, do you have statistics on how many were incidents of racism? If so, can this figure be included for each month?

I understand this may be quite the task to put these figures together, I’m willing to accept a small but reasonable delay in getting the figures back.

Thank you for your request for information as below.

The Freedom of Information Act requires that this request is dealt with in a manner that is motive and applicant blind. A disclosure under this legislation is considered a disclosure to the world and is considered to be on the basis that it is in the public interest.
This response is unique to Humberside Police and you are advised not to compare this like for like with any other force's response you receive.

Humberside Police Response
It has been determined it would not be possible to answer the request in full within the time limit of 18 hours. In order to provide the conviction data would require a search of all cases and checks to be conducted on each individual.

Therefore s12 of the Act applies.
Section 12 - Exemption where cost of compliance exceeds the appropriate limit.
s1(1) does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the 'appropriate limit' (18 - hours).

Activities that may be counted within our time estimations are:
* Determining if the information is held;
* Locating the information, or a document containing it;
* Retrieving the information, or a document containing it; and
* Extracting the information from a document containing it.

The following have not been included within our calculations:
* The time spent identifying information to be exempted
* The time dedicated to the process of redaction.

Please take this as a refusal notice in accordance with section 17(5) of the Act which states; A public authority which, in relation to any request for information, is relying on a claim that section 12 or 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact.

Although excess cost removes the forces obligations under the Freedom of Information Act, as a gesture of goodwill, I have supplied information as attached. The hate crime flag was not selected on 217 crimes so some of these may be race related.

Hate crimes will not be tolerated across the Humberside Force area. We would encourage anyone who has been the victim of this type of offence to please come forward and report it to us.

We want people to be confident they can report these types of crimes to us and know that all reports received will be taken seriously and treated sensitively.
