I can confirm that the Council does hold a copy of this report, however,
we are refusing to provide a copy under S21 of the Freedom of Information
Act on the grounds that the information is readily accessible elsewhere. 
This exemption applies even where the information is only accessible on
payment.  I am sorry that we did not make this clear in our response to
you.

Thank you for admitting that the Council hold the information, and confirmation of the refusal and the exemption S21, that Nottinghamshire County Council is claiming.

I am aware, as you say that this exemption applies even where the information is only accessible on payment. However the exemption is also dependent on the individual.

I am on very low pay and cannot afford this sum, especially doing the research I do on child abuse and thus ask you to provide this to me digitally.

Please could you confirm or correct me under Section 16 that
1. the Death of Leanne White Report was authored by the Nottingham Area Protection Committee
2 The successor organisation to this NAPC is the Nottingham County Council
3. Please could you provide documentation, if appropriate, under a new request if necessary, that the £12.30 copyright cost of the Report via the British Library goes to Nottingham County Council .
4. Please could you state how much copyright fee in 2012 and 2013 from sales of the report went to Nottingham County Council.

Further, separately to all the above and separately to the 2000 Act of the Freedom of Information, I ask Nottingham County Council to publish the report digitally either in reply to this request or in their Publication Scheme so that
1. All researchers into child abuse have free and easy access to essential information about Britains history of child abuse
2. The lessons of her death are learned by the most people possible
3. There is no question of Nottingham County Council appearing to profit from a death for which they may been partly at fault.
4. Nottingham County council are taking a moral and ethical decision

relation to the following questions:

 

1.The Death of Leanne White Report was authored by the Nottingham Area

Protection Committee?

Yes.

 

2.The successor organisation to this NAPC  is the Nottingham County
Council?

The successor is the Nottinghamshire Safeguarding Children Board.

 

3. Please could you provide documentation, if appropriate, under a new
request if necessary, that the £12.30 copyright cost of the Report via the
British Library goes to Nottingham County Council .

We have no record of an agreement for copyright fees to be paid to
Nottinghamshire County Council but have checked financial records and
found no evidence of any payments being received in 2012 and 2013.

 

4. Please could you state how much copyright fee in 2012 and 2013 from
sales of the report went to Nottingham County Council.

In relation to your request for Nottinghamshire County Council to publish
the report digitally either in reply to your request or via the Council’s
Publication Scheme. The  Council is in the process of determining whether
the published version, available via the British Library West Yorkshire,
is the same as the version held by the Council. If this is the case a
review of the previous decision will be undertaken. I will contact you
again, as soon as possible. We envisage this will be by the middle of
April, at the latest.

On 14 March, my colleague Paula Laws sent an e-mail to you informing you
that the council was reconsidering its earlier decision to exempt the
report from release. This has now been done.

 

Our view is that in accordance with FOIA the original exemption under
Section 21 (Information accessible to applicant by other means) is still
valid. However in the interests of openness and transparency, we have
decided to publish the report on our disclosure log, and I also enclose a
copy with this e-mail.
