May I bring to your attention the ACPO Manual of Guidance Freedom of Information Act 2000 Version 6.1

Page 31:

[The time limit in which forces have to respond to requests is very clearly defined in the legislation and ICO guidance. Requests must be answered as soon as practicable, and in any case within 20 working days. It is important to remember that day ‘1’ will be the day after receipt.]
and
[The 20 working days time limit becomes effective on the day of receipt or the date on which further information that has been reasonably required has been received. Where a fee is charged, the 20 day compliance time period will begin again upon clearance of the applicant’s cheque.]

So day 0 was the 7th October. Day 1 was the 8th October.

However in this instance your request was received by this office on the 8th as you submitted your request after office hours on the 7th, therefore your first day of your request was the 9th October. I trust this clarifies this matter.

We are a very busy team and we are endeavouring to reply to the vast number of requests that are submitted in accordance with the legislative timescales. I thank you for your patients.

Page 9. Section 34

34. For the purposes of the Act, a ‘working day’ will end at midnight regardless of the opening hours of the authority. Therefore, any request which arrives before that time should be regarded as having been received that day.

I trust that there is no issue and that this is still the case. The ICO does refer to an obligation to respond promptly :

"It is, however, theoretically possible to find that a public authority’s duties under section 1(1) were complied with within 20 working days, but still not promptly."

I feel this response is neither prompt nor 20 working days so will invoke an internal review if there is no response today. I have already spoken to the ICO office today on the telephone to confirm what i can do when a public authority fails to act promptly.
