Renumeration package

Dear Wirral University Teaching Hospital NHS Foundation Trust,

Currently there is an Acting Divisional Manager for Anaesthetics and Critical Care. I would like to know the length of the agreed temporary contract, which I believe is soon to come to an end, and the total renumeration package associated with this contract. I do not wish to receive any information regarding previous or future permanent holders of this position.

If the Acting Manager has been appointed on a standard Band 8 Agenda for Change contract and paid accordingly then you need only state that. If the contract is an enhanced one with higher levels of renumeration then please could you state the reasons for this?

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Wirral University Teaching Hospital NHS Foundation Trust's handling of my FOI request 'Renumeration package'.

The response to an apparently straight forward request has not been dealt with. It is my understanding that, by law, the authority should normally have responded promptly and by 16 February 2012. Out of courtesy the least the trust could have done was to have kept me informed if accessing the information for this simple request was proving problematic.

Please find attached our response to your recent request for information
in accordance with the Freedom of Information Act.

 

We did advise in our acknowledgement letter that our response would be
sent to you by 17th February which is today. This is because although your
initial request was received by the Trust on 19 January at 22.17 hours
this was after normal office hours and therefore the clock was started on
20th January.

 

The Trust receives many requests for information and these requests must
all be dealt with in the order in which they are received to avoid
breeching the legal timeframes.

Thank you for your last-minute response which I consider to be unsatisfactory.

In choosing to reply at 4.30pm on the last possible day ,and then only following my request for an internal review, you have complied with the letter of the law but certainly not with the spirit of it.I might have understood if your response contained detailed information, but it is surprising that it took four weeks to inform me that the information was covered by Section 40.
I would argue in this case that section 40 of The Data Protection Act would not apply for the following reasons
1) I am not asking that the individual be named, therefore his/her personal data is not at risk of exposure.

2)As a public body I believe that the trust is required to publish an annual Statement of Accounts which would include this information. As the information would then be in the public domain it seems illogical to argue that it cannot be made public at this stage.

I would remind you that those who work in the public sector are paid with public money and therefore the need for openness and transparency with regards to remuneration should be anticipated by all who work in the public sector.
I wish to continue with my request for an internal review of your handling of my original enquiry.

May we advise that it is recorded that the response to your request left
the Trust at 14:02 on the 17^th February 2012.

 

However, we did advise you in our response that the Trust receives many
such requests for information and these requests  must all be dealt with
in the order in which they they are received to avoid breaching the legal

Therefore, this does sometimes mean that the Trust is unable to respond

Please be aware that the Information
Commissioner's guidance on Internal Reviews, which says that "a review must be ... thorough and swift and the outcome must be notified promptly to the complainant", that "a one stage review should be completed in 20 working days"

This is a straightforward FOI request which seeks to find out how PUBLIC money is being used by the Trust. and we are at a loss as to why you seem unwilling to supply this information
