Further to our acknowledgement of 13 December 2012, I am now in a position
to provide you with a response to your request for information of the same
date. 
 
We have dealt with your request in accordance with your ‘right to know’
under section 1(1) of the Freedom of Information Act 2000 (FOIA), which
entitles you to be provided with a copy of any information ‘held’ by a
public authority, unless an appropriate provision in the Act applies to
the request or an exemption applies to the information.
 
Request
 
You requested:
‘ 1) Please provide me with a copy of your response to the FOI request
reference IRQ0361221 that was previously available on your website.
 
2) Please provide me with any internal correspondence relating to the
removal of the response to FOI requests reference IRQ0386211 and
IRQ0361221 from your website.’
 
Information Held   
 
I can confirm that we hold recorded information which falls within the
scope of your request.
 
In relation to the request numbered 1) above we have provided a copy of
the response letter and the information provided.
 
As I understand it, your request was for the response that was previously
available on our website and therefore, in line with our usual disclosure
log policy, we have provided a copy of the response without the personal
data of the requestor. In the circumstances I did not therefore consider
it necessary to quote the relevant exemption.
 
 
In relation to the request numbered 2) above we have a provided a copy of
the internal correspondence relating to the removal of the information
request IRQ0386211 from our website. I can confirm that no recorded
information is held relating to the removal of information request
IRQ361221 from our website.  
 
You will see that a minor redaction has been made. The information that
has been redacted is the name of the individual within the ICO
Communications department who removed the entry from the disclosure log.
 
As you will be aware the names of ICO employees constitute their personal
data.  Section 40(2) of the FOIA allows a public authority to withhold
information from a response to a request when the information requested is
personal data relating to someone other than the requestor and either the
first or second condition in Section 40(3) is satisfied. In this instance
the relevant condition of Section 40(3) is (a)(i) regarding whether to
disclose such information would contravene one of the Data Protection
principles.
 
For your information the ICO has an internal policy on the disclosure of
personal data about ICO employees.  A copy of the policy is available from

In light of our internal policy on releasing information about ICO
employees who are not customer facing or above a certain level, this
information is exempt under Section 40(2) of the FOIA by virtue of Section
40(3)(a)(i).  Given our policy, we consider that such a disclosure would
be unfair and in breach of the first Data Protection principle which
states that – “Personal data shall be processed fairly and lawfully”.
 
 
As we recall, and as the recorded information being provided confirms, it
became apparent that there was an increasing need to contextualise the
information being provided in response to these  types of requests for
statistical information about casework. A commentary was required to
explain the information to avoid misunderstanding and confusion and to be
fair to those who are the subject of the information.
 
This continues to be work in progress but can be illustrated by our
response to a similar and more recent request (IRQ0396111) which is
currently included in our disclosure log and as referenced in the string
of emails provided:
