Thank you for your e-mail in which you asked can a Trustee of a charity be
removed by the Commission if they misrepresent expenditure within the
charity's accounts.
We have assessed this request as not falling under the FOI Act 2000 as it
is not a request for documents or information held by the Commission as a
record but a general enquiry about the Commission’s powers.
The Commission’s has powers to deal with trustees who have committed a
breach of trust or duty under sections 76-84b of the Charities Act 2011 as
altered by the enactment of The Charities (Protection and Social
Investment) Act 2016.

complies with its legal obligations to be open and honest in its
