1) Can you clarify who was in charge of Kent Children’s Services when the appalling murder/manslaughter of Tiffany Sellman Burdge took place? If we can trace him perhaps we can see what he is doing at the present time.

Apparently after the murder of Tiffany Sellman Burge laughably Badman went onto to review procedures in Haringey writing a second serious case review. I guess he could not write one on his own conduct as head of Kent Children’s services where he allowed this appalling crime to take place with two children already removed for quote “neglect”.

So Badman was in charge when baby Sellman got a fractured skull and presented Kent Police with 5 different versions of how it happened. After a so called “robust” investigation by Kent Police he got off with manslaughter. Not a bad result for a chap with 5 different versions of how his baby daughter met her death.

1. Graham Badman was Managing Director in 2008 when the manslaughter occurred

2. Graham's donations to charities were private to him. We do not hold this information and therefore cannot answer this question

3. The Managing Director of Children, Families and Education's salary for the financial year 2009/10 fell within the band £175,000 to £185,000. She, along with the other Chief Officers in Kent County Council have voluntarily agreed not to take any performance payment to which they are entitled for this year. The substantive salary will not increase from its current figure in 2010/11, as KCC is not awarding any cost of living pay increase this year.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'REMEMBER Tiffany Sellman Burdge'.

It is most honourable that these overpaid “chief officers” do not take a performance bonus.

I do not feel my questions were properly answered and I was also concerned with the response to question 3 which would appear inaccurate based on information widely published in the national media.

Regarding question 1. Managing Director of what exactly?

Regarding question 3. I was under the impression that performance payments have been made this year. Recently Peter Gilroy OBE was paid £200,000 on the grounds that he was “an outstanding public servant”.

How was the above payment classed by Kent County Council? This being the payment to Peter Gilroy OBE of £200,000 Sterling?

Five years for killing his baby, i work in the prison where this animal is currently being held he is being protected soas to avoid any further attacks on him, does he show remorse i would beg to differ, he still smiles that baby will never smile again it really is a disgrace as he could be out in 2 and a half years time when he can smile and get on with the rest of his young life. I guess the message here is kill your baby and get out real soon.

I am sorry you are unhappy with my colleague's response to your request
for information, specifically KCC's answers to question 1 (you believe the
answer provided needs further clarification) and question 3 (you believe
our answer to be inaccurate).

The purpose of an internal review is to investigate and ascertain whether
the public authority, in this case KCC, has complied with Freedom of
Information legislation, namely to confirm or deny that whether KCC holds
the information requested, and if it does, to supply it to you within
20-working days subject to any exemptions to disclosure that may apply.
Therefore, on behalf of the interim Chief Executive, I have revisited
these two elements of your request to see if KCC has satisfied its
obligations under the Act.

You asked (1) Can you clarify who was in charge of Kent Children's
Services when the appalling murder/manslaughter of Tiffany Sellman Burdge
took place? If we can trace him perhaps we can see what he is doing at the
present time.

Ms Hunt responded by advising you that this was Graham Badman, so this
element of your request has indeed been satisfied in accordance with FOIA.
However, I do note your comment that his job title could have been clearer
so to clarify, Graham was the Managing Director of KCC's Children,
Families & Education Directorate which incorporates Children's Social
Services.

You asked (3) What pay is Rosalind Turner taking this year?

Ms Hunt responded by advising you that the current Managing Director of
Children, Families and Education's salary for the financial year 2009/10
fell within the band £175,000 to £185,000 and that she, along with other
Chief Officers in Kent County Council have voluntarily agreed not to take
any performance payment to which they are entitled for this year. So
again, this element of your request has been satisfied in accordance with
FOIA.

You have challenged the accuracy of this response based on your
interpretation of information from other sources. I would point out that
the fact that you do not believe that the information held and provided to
you by KCC relating to Ms Turner's remuneration is correct, falls outside
the scope of an FOI review. However, for clarity, I can confirm that the
£200,000 payment to Peter Gilroy was not performance related. This
payment was authorised by the Council's Personnel Committee in November
2006 as a retention allowance to secure his services for a further period
of three years (Mr Gilroy could have retired in April 2007).

But I do note that as your request was received on 1st April, you should
have received a reply as soon as possible but in any event, no later than
29th April. The response to your request was not emailed to you until 14th
May so I accept that KCC failed to comply with statutory timescales on
this occasion and I therefore uphold this element of your complaint and
offer my sincere apologies on behalf of the Council.

I trust that this explanation now satisfies your complaint. However, if
you are still unhappy with the decision, you can appeal to the Information
Commissioner, who oversees compliance with the Freedom of Information Act

Dear Kent County Council,

According to the Daily Mail the payment was made as Peter Gilroy (Associates) and other outfits he has running. NO doubt we are all aware from this website Peter Gilroy appears to use various alias/bogus names for his holding companies/Vat rip off and what have you.

In any case the Daily Mail which is considered right of centre claims Peter Gilroy received the payment for being quote ‘outstanding public servant’.

So is this performance related? Have KCC got a document on what is performance related as we already know Graham Badman who presided over the avoidable murder of poor Tiffany was given a huge payoff by KCC.

Please explain?

Just to clarify on a point of error it’s not Vat rip off apparently it has something to do with Peter Gilroy’s pension. So guess that might not be a Vat rip off call it a council tax payer rip-off. But just to make clear I don’t believe there is any evidence that Mr. Gilroy has evaded Vat not that he would need to as Kent County Council probably pay this anyway. Maybe we should ring Iceland to ask for advice? I just lost 50 million pounds of taxpayer money, should I accept the bonus?

Peter Gilroy’s bonus say’s a lot about what is wrong with this country at the moment. We need to get on top of this filthy corruption and dirt.

Peter Gilroy should give this money back to the council or give the money to charity. This view is supported by many KCC staff as evidenced in the local media. Whilst their pay has been frozen Peter Gilroy takes this disgraceful cash bonus.

On a final point this post was about the death of Tiffany Sellman Burge I think we obtained some useful evidence in this regard and I don’t care about Peter Gilroy. I don’t want to know about him or what he does with this money.

To reiterate my previous response, Peter Gilroy's £200,000 payment was
NOT performance related and was agreed in November 2006. Please see page 2
of the minutes of the Personnel Committee meeting in November 2006

Ms Turner's salary (or pay) is £180,000 per annum. You asked "what pay is
RT taking this year?". The answer was given correctly as between £175,000
and £185,000. However, the Statement of Accounts, which is where the
Press obtained their figures from, gives details of total remuneration
which includes not only salary (pay) but any benefits in kind and the cost
to KCC of employer contributions to the pension fund. So both figures are
correct.

If you remain unhappy with this response you should either escalate your
complaint to the Local Government Ombudsman if you consider KCC is guilty
of maladministration. Please see the Ombudsman*s website

The relative, who asked to remain anonymous, told the BBC he had contacted social services on two occasions to warn them that Sellman's partner was expecting a child.

He said: "I feel the information I passed on was not listened to.
"If they had done more checks on the computer, they may have found something out. Maybe the baby would have been better looked after."
Within 25 days of her being born prematurely, Tiffany suffered a fractured skull and died in hospital after being left in her father's care.
