Dear Sandwell Metropolitan Borough Council,

I am writing to make an open government request for all the
information to which I am entitled under the Freedom of Information Act and the environmental information regulations.

In order to assist you with this request, I am outlining my query as specifically as possible. If however this request is too wide or too unclear, I would be grateful if you could contact me as I understand that under the
act, you are required to advise and assist requesters.

Could you supply me with the following information.

The cabinet report concerning the “relocation” of Canada geese from Victoria park Tipton and Dartmouth park undertaken by PESTEX last year in July.I cannot find any such document on your website, does it indeed exist?
On 16th July PESTEX again removed around 70 geese from this park. What approval has been given for this operation? I am requesting relevant emails or correspondence which give approval for this task, as well as for that last year. I am also requesting the cost of this operation and which budget it came from.
Can I ask for confirmation that these birds were killed by this pest control company and this task was therefore authorized by a Sandwell council officer or cabinet member.
I am certain that these birds were not “relocated” to the stated area that they were going to, and this would require authorization from Natural England in order to do this. Could you therefore supply me with the licence that you obtained from them to relocate these birds which were transported by the pest control company unrestrained in the back of a horse trailer for approximately 3 miles if the claim of “relocation” is to be believed.

I understand that under the act, I should be entitled to a response within 20 working days.
I would be grateful if you could confirm that you have received this request. I look forward to hearing from you in the near future.

SANDWELL COUNCIL ADMIT KILLING BIRDS FOR THEIR GREEN FLAG PARKS.

I was sent a reply to this request to my home address, which was of course an attempt by SMBC to prevent the public release of this information.

They have now claimed that the response was not sent to the WDTK website as an oversight- really I don't believe that at all. We await to see if they will now belatedly send it.

The answer to question 1 of this request poses more questions

“There was no cabinet report regards approval to relocate the geese. A cabinet briefing was presented to the cabinet member – this is not a public document. We do not hold any information regarding the approval of the process; as such approval was given verbally for 2013/14.”

Why is this NOT "a public document", and how were the geese actually killed? THE COUNCIL ARE NOT SAYING.

I am writing to request an internal review of Sandwell Metropolitan Borough Council's handling of my FOI request '"relocation" of Canada geese'.
On the specific issue concerning question 2 of my request you answered

“A2 The briefing was approved to remove the geese from both Victoria Park and Dartmouth Park in 2013 and to repeat the action in 2014.
Section 21 of The Freedom of Information Act 2000 allows public authorities not to disclose information reasonably available to the requestor by other means, in this case, the information you have requested is already publicly available on:

The budget for this work was funded from the Parks and Countryside revenue budget.”

In your response to question 2 of my request you state that the information could be found on your website and directed me to the above link on your website. I cannot find any information related to this at this link and it is not a very helpful link given- A vast number of pages. Can you therefore provide me with the specific document and page on which the cost of this operation to kill the birds using contractor pestex is stated, or preferably provide me with the information- which I do not believe is currently publicly available.

This response was an "internal review"?!

The figure that they say was already publicly available wasn't. The information requested was sent in another request and only for 2014 and not 2013. The 2014 payment was £550 for EACH park making a total of £1110. So even the information contained in this "review" is misleading.
Currently waiting for SMBC to answer the second request via the WDTK website as requested and not to my home address.

Well, Sandwell Council are certainly 'not' working for me. I would of opposed this action, it's a total waste of public money!

and you wonder why rate payers are un-happy to pay their rates when its wasted like this!

How can a Council be allowed to "LIE" to the public, saying they are 'relocating' the Canadian Geese..... You arranged and PAID TO HAVE THEM KILLED!!!!!

Sometimes I do wonder about the people that work inside Sandwell Council, I wonder of there motives for the actions taken....... I mean look at Jewel of Great Barrs Crown.... Red House in Red House Park, what an honour to have this priceless building in our possesion - well, not if its owned by Sandwell Council. So many fantastic uses this building could be put to for EVERYONE to enjoy - but, NO, we have other plans for this and we will not be changed. (Still waters run deep and all that).

In the words of Queen.... another one bites the dust, and another one gone and another one gone.

Sandwell Council you do really make me feel ashamed to 'live' in this area.

Please look in to the actions of the person responsible for organising this cull and more important, DON'T LET THIS HAPPEN AGAIN, STOP THIS SLAUGHTER NOW.
