Dear East Devon District Council / Denise Lyon / Monitoring Officer,

1. Can you please provide me with the up-to-date business case for relocation from the Knowle including details, pros & cons and costs of all recommended and rejected options.

2. Can you please provide me with a list of all public and private meetings held with Councillors relating to the Knowle relocation, including details of invitees and attendees.

3. Can you please provide me with copies of all minutes of all meetings with Councillors related to the Knowle relocation.

4. Can you please provide me with a list of all reports provided to Councillors pertaining to the Knowle relocation.

5. Can you please provide me with copies of all reports provided to Councillors pertaining to the Knowle relocation.

6. Can you please provide me with the detailed scope / statement of work for any external consultants working on the Knowle Relocation.

7. Can you please provide me with a breakdown of costs to date relating to the Knowle relocation (including both explicit external costs and an estimate of internal costs), and the latest estimate of future costs (both capital and revenue) pertaining to the recommended option.

Please note that I am only requesting information where Councillors and / or the DCOE responsible for this project have been involved, and not information / communications which were purely internal between EDDC officers and not involving Councillors or the DCOE.

Internet web links which point directly to the information requested are an acceptable response.

In the event that you deem any of these to be confidential, for each piece of information that you deem to be confidential, can you please state explicitly the detailed grounds for considering it confidential bearing in mind the legal requirements of the Freedom of Information Act, the Local Government (Access to Information) Act 1985 and any other legislation pertaining to local government requirements to take minutes of meetings and to making information available.

In the event that you decide to make redacted copies of minutes or reports available rather than the full unredacted copies, can you please state explicitly the detailed grounds why the full unredacted copies cannot be provided, and the detailed reasons for each area of redaction, bearing in mind the legal requirements of the Freedom of Information Act, the Local Government (Access to Information) Act 1985 and any other legislation pertaining to local government requirements to take minutes of meetings and to making information available.

I understand that previous FoI requests by other parties have been denied on the basis of confidentiality, that these have been referred to the ICO, and that the ICO made a ruling based on the status of the project at that time, specifically that a decision to relocate had not been made. Since the project has now progressed and the situation has now changed, if you still deem the same (or even different) information to be confidential for the same reasons, can you please provide explicit explanation as to why these should remain confidential given the previous ICO ruling.

I note that the Freedom of Information Act allows you 20 working days to provide this information, so I look forward to receiving your full response by 20 May at the latest.

Since this is potentially one of the most important and costly decisions / projects currently being undertaken by EDDC, one which essentially relates to overhead expenses rather than costs of direct provision of services to EDDC residents, and which therefore justifies the greatest openness, discussion, debate, scrutiny and accountability of Councillors, disclosure of this information to allow informed debate before a final and possibly irrevocable decision is made is in the public interest and I would ask you to bear this in mind when considering your response to this FoI request.

The minutes of groups specifically involved with discussions about the
re-location project have been found to be exempt from disclosure as
confirmed by the ICO in a recent decision notice. No formal decision has
yet been taken on this live project.

I am writing to request an internal review of East Devon District Council's handling of my FOI request 'Relocation from the Knowle'.

1. I asked for the most recent business case but was pointed to a web page on the EDDC site and the agenda for a cabinet meeting in July of 2013, neither of which contained the business case requested.

If you do not have a business case please state this.
If you have a business case but are unwilling to disclose it, please say so and clearly state the grounds for withholding it.

2.I asked for a list of public and private meetings held, but this was not provided nor was any explanation provided about why not.

Instead you explained why you were not able to provide me with the minutes of such meetings.

Can you please either provide the list of meetings, or clearly state the basis for withholding it.

3. Accepted.

4. I asked for a list - you suggested I search your web site. Your answer was not responsive.

Can you please either provide the list of reports, or clearly state the basis for withholding it.

5. Your answer assumes that all reports are available on your web site, but without the answer to 4. I am unable to verify that I have found them all.

6. Accepted.

7. The costs in link 1 are not broken down and the costs in link 4 (to the cabinet meeting of July 2013) are not current, so this answer was not responsive to the question.

Can you please either provide the breakdown of current costs, or clearly state the basis for withholding it.
