I would like to make the following requests for information based on your newsletter detailing the regulatory judgements made by the HCA.

2 The criteria for deciding which Housing Associations are subject to a regulatory review, and how frequently regulation takes place. If this information is already published, please provide a link to the relevant documents, otherwise please publish any relevant documents on this site.

3 A copy of the regulatory report of Sovereign Housing.

Dear Homes and Communities Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Homes and Communities Agency's handling of my FOI request 'Regulatory Judgements'.

Taking the request in order, I asked for:

"1 Any discussion papers, board minutes, memos, emails, guidance etc
held in relation to the decision not to publish all the regulatory
judgements."

You have only provided one undated paper marked 'FOR DECISION". Please can you provide the parts of the document from which this paper is extracted that will put it in context (ie explain who was asked to make the decision and why). You have also not provided any minutes, memos, emaills guidance etc. it seems very unlikely that there are no further documents held that fall within the scope of the request, particularly given the "next steps" detailed in the report, transcribed below:

"17 If the committee is minded to adapt the regulator’s approach to producing and publishing regulatory judgements, as proposed, the first step will be to take informal soundings from a range of stakeholders to make sure that the proposals do not raise significant concerns. Assuming that they do not, it will then be necessary to reflect our changed approach in ‘Regulating the Standards’.
18 Further steps would also include work this year to set up and populate the table showing our current judgements for all registered providers. For those providers where we would continue to produce an RJ because of a grading change, these will also need to be produced and published on line.
19 In addition, more detailed work will be required to ensure that the triggered RJ approach fits with other internal operational processes so that there is a clear system in place for identifying and managing future RJs. This will need to integrate publication of RJs with quality assurance processes, such as the stock takes introduced earlier this year."

If you are applying exemptions and/or consider that the above are not within the scope of my original request then please advise me accordingly. I note that I prefixed 'minutes' with board, not committee but I think my intent was clear.

You have provided various links, and there is a lot to read through. Do you have any internal guidelines that might provide a more succinct response?

The link you have provided doesn't seem to lead anywhere. Please can you attach the reports instead? Also, I was hoping for a copy of the report supporting the entry in the table of your regulatory judgements that lists Sovereign HA as having a regulatory review in December 2012. I realise that a formal "judgement" has not been prepared, but I would like to see the underlying report that brings the HCA to support the rating only judgement that has been published.

Thank you for your email in response to mine dated 13 February 2013.

In your email you ask for clarification in relation to the sections of the Freedom of Information Act (the Act) that are being applied to extend the period of time for your internal review.

As outlined in my letter, there are no statutory requirements/provisions in the Act to complete internal reviews within a specified timeframe. However, in accordance with best practice the HCA aims to complete internal reviews within 20 working days, or where this is not possible within a further 20 working days.

For the avoidance of doubt, the HCA has not extended the period of time as permitted by the Act to consider the public interest test arguments. Accordingly the HCA are not relying on any sections of this Act in relation to this extension.

I apologise for the delay and confirm that you will receive a response on/or before the 27 February.
