REQUEST REF: 0701-12

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Foreign and Commonwealth Office's handling of my FOI request 'Regulations'.

I clearly requested "an electronic copy of the current (...) Diplomatic Service Regulations (or their
successor documents if they have been renamed). For reference, I am interested in the detailed regulations, eg. 'Diplomatic Service Regulation 5: Confidentiality and Official
Information.'"

Your response provided a link to the Lexis website, which appears simply to be a copy of the Constitutional Reform and Governance Act section stating, "The Secretary of State must publish a code of conduct for the diplomatic service."

You have not provided, or directed me to, a copy of the actual code, and are therefore in breach of the Freedom of Information Act.

My apologies that the links in my reply to your recent FOI did not supply
the information you requested. As we are unable to supply the information
electronically we searched extensively to discover an electronic copy of
the Diplomatic Service Regulations (or their successor documents if they
have been renamed). We thought we had found them but obviously we were
wrong. All that we can do is send you a hard copy through the post if this
is acceptable.

Thank you for your reply stating that no electronic copy of the Diplomatic Service Regulations exists.

I must say I find this rather strange, given that the Diplomatic Service is obviously spread out across the world and presumably relies heavily upon technology and intranet systems.

The Freedom of Information Act 2000 requires you to provide the information in the format requested, ie. electronically, if "reasonably practicable."

Therefore, I would expect you to consider the possibility of scanning the Regulations (presuming you have a scanner in the building) and it seems likely that this would anyway benefit the FCO since it would then hold an electronic copy of this important document and could provide it more easily to staff serving abroad.

It will obviously take me some time to photocopy the regulations and get them scanned. Are you happy for me to do this instead of undertaking an Internal Review? I hope to be able to send the scanned copy by email within 7 days.
