Please confirm the registration status of the afore-mentioned
It appears from your online register that the afore-mentioned lost his medical registration on 3 May 13.
However, he was again not only restored to the medical register on 1 Nov 13 but also to the specialist register for trauma & orthopaedics on 1 Nov 13. Can the GMC explain this?
All disciplinary & fitness to practice history about Stephen Krikler's history (which should be in the public domain) is concealed by the GMC. Why is that?

In violation of the FOI Act, the GMC refuses perfectly legal freedom of information requests about Stephen Krikler. Why is that?

Thank you for your email dated 24 July 2022, where you ask for information
on Dr Stephen Krikler. I’ve considered your request under the Freedom of
Information Act 2000 (FOIA).

 

Publicly available information about the doctor’s registration is on our
List of Registered Medical Practitioners (LRMP), which can be found on our
website: [1]www.gmc-uk.org.

 

Under the FOIA I am unable to confirm whether or not we hold any
information in relation to your request, because it would breach data
protection legislation to do so.

 

We believe it’s reasonable for doctors and complainants to expect that
complaints will be treated as confidential. If a case progresses to a
hearing, or an investigation concludes with a warning or undertakings,
certain information may be made publicly available by the GMC, in line
with our publication and disclosure policy for fitness to practise
information. Otherwise the information is treated as the confidential
personal data of the doctor and other parties involved. I’ve given details
of the exemption under the FOIA which applies below.

 

The exemption

 

Section 40(5B)(a)(i) of the FOIA applies where the information, if held,
would be the personal data of a third party and where confirming whether
it’s held would breach any of the principles relating to the processing of
personal data listed at Article 5 of the GDPR.  I believe that to publicly
confirm or deny whether we hold the information would breach the first
principle, which requires that the processing of personal data is lawful,
fair and transparent. I do not believe that any of the legal bases for
processing listed at Article 6 of the GDPR are met and therefore giving
you the information would be unlawful.

Dear Remi Owolabi,

It is illogical & defamatory on your part to claim that I seek any personal data on Stephen Krikler.

It is evident instead from the General Medical Council (GMC) web-site that Stephen Krikler was erased following Fitness to Practice procedures. While the said proceedings are no longer in the public domain Stephen Krikler's erasure is.

Following his erasure Stephen Krikler was restored within 5 months by the GMC in violation of the Medical Act 1983.

The GMC's information access team as the data on this web-site shows thwarts any inquiries about Stephen Krikler & threatens the public with the GDPR when no such exception is made for other doctors.

Instead it is the GMC that misrepresents the Freedom of Information Act & misapplies the GDPR in Stephen Krikler's case.

Under the Freedom of Information Act the public has a right to know who illegally restored Stephen Krikler to the medical register & why he is still registered when he could possibly not have applied for restoration before 2018.

The Fitness to Practice proceedings relating to Stephen Krikler should also be in the public domain.

The GMC has a duty to disclose to the public who bends the rules for Stephen Krikler.

On the other hand there is plenty of information on this site alone that you threaten members of the public when they ask valid questions about Stephen Krikler’s registration (or lack thereof. While you pretend not to know about it in an earlier request about Stephen Krikler

Mark Ellen of the GMC repeatedly claimed that references to Stephen Krikler not having registration were ‘defamatory’. Do you at least concede that your position has changed since & that true statements about Stephen Krikler not having registration are not libelous?

Moreover, the prolonged argument in which you have thus far engaged me does nothing to disclose whether or not Stephen Krikler is in the medical register which is very much in the public interest.
