Dear Rob Blackie,

 

I refer to your email request of 25 June 2019 made under the Freedom of
Information Act 2000 (“the FOIA”) whereby you requested information about
the number of EU citizens that completed a UC1 form and were therefore
eligible to vote in the European Elections on 23 May 2019.

 

The registration of electors is governed by the Representation of the
People Act 1983 (“RPA 1983”) as amended. Under Section 8 of the RPA 1983,
the City of London Corporation must appoint an officer to be registration
officer in respect of elections for the part of the constituency
containing the City and the Inner Temple and the Middle Temple. I am the
appointed officer for this electoral registration area. My appointment as
Electoral Registration Officer is separate to my appointment as Town Clerk
and Chief Executive and, although appointed by the City Corporation, the
Electoral Registration Officer’s responsibilities and duties are personal.
An example of this is that the register of electors is deemed to be the
property of the Electoral Registration Officer, not the City Corporation
as local authority.

 

The Electoral Registration Officer does not carry out the duties on behalf
of the local authority but in his own personal capacity. The Freedom of
Information Act (FOIA) does not list any person appointed under the RPA
1983. It follows that the Electoral Registration Officer, Returning
Officer or any other person appointed under the RPA 1983 are not subject
to the FOIA. For clarity, as indicated the local authority is a separate
body from the Electoral Registration Officer (and the Returning Officer)
and their respective office.

 

Notwithstanding that there is no statutory obligation to provide the
information you have requested, I can nevertheless confirm that the number
of EU citizens registered to vote in the City of London that completed a
UC1 form successfully and prior to the deadline was 216.
