Dear Mr Rob Blackie,

Thank you for your FOI enquiry requesting information relating European elections 2019.

The Electoral Registration Officer (ERO), Acting Returning Officer (RO) and Counting Officer (CO) are appointed under the Representation of the People Act and are ‘statutory office holders’.

This means they carry out their elections duties in their own personal capacity and not on behalf of the council. In addition, those who undertake elections/referenda work on behalf of these statutory office holders do so under their direction and not the council.

The ERO/RO/CO is not subject to the Freedom of Information Act 2000. This is because the Act only applies to ‘public authorities’ and the CO/ERO or RO is not a public authority for the purposes of the Act because they are not listed in Schedule 1 of the Act and a Ministerial Order under s5 has not been made defining them as a public authority.

Consequently, we are unable to provide you with the information as requested.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of your handling of my FOI request concerning Registration for the European Elections.

This information has now been provided by 12 London boroughs.

This information clearly falls under the scope of the Freedom of Information law - and all of these 12 boroughs have judged that to be the case.

I am asking for extremely limited information - simply a count of the number of people who returned a form. This is extremely simple to provide - in any database system it would be the work of a couple of minutes.

You can't get any information as there is case law on this area.

The Association of Election Administrators from what I understand advices returning officer to work with FOI but it can't compell them.
