Dear Oldham Metropolitan Borough Council,

I would like to request under the Freedom of Information Act data I believe to be held by your authority concerning marriages.
In particular, I would like to request information on what documentation prospective couples have to present to prove they are not related.
I would like to know the number of marriages which were blocked or prevented from proceeding because of a lack of this proof.
In addition, I would like to know the number of marriages in your area for the past five years. Can you break down this figure to show marriages between First Cousins?
Could this figure be broken down to include the ethnicity of both parties and their gender.
Also, I would like to know any policy or guidance you may have concerning the marriage of first or second cousins.
I would appreciate it if this information could be supplied in an Excel or CSV format.

Good afternoon,

 

The registration service is not subject to the provisions in the Freedom
of Information Act, as this act refers to “public authorities” and
registration officers are Statutory Officers, therefore not covered by
this act.

 

It is also not possible to decipher marriage data by relationships or
ethnicity. The Marriage Acts require parties to a marriage to attend
before a registration officer and attest that they are free to marry. They
are signing a declaration to the effect that the information they are
provided is accurate and are advised that if a false statement is given
they are liable to prosecution which would also be the case if they were
not able to enter in to the marriage. Currently the law allows for a
marriage were the parties are cousins and as such there is no requirement
to provide evidence of this fact. If a couple state that they are not
related then there would be no evidence to this effect.

 

For information relating to legal requirements of marriage law you may
wish to enquire with the General Register Office for England and Wales.
