FOI LORDS, House of Lords

Dear Mr. Peach

I am writing in response to your request for information received by the
House of Lords on 18 August.

Information relating to the registered residential addresses of Members is
held by the Finance department for the payment of travel related expenses.
Members residing overseas may only claim travel expenses for the journey
from the point at which they enter the UK, such as an airport or port, to
Westminster. As the information you have requested relates to residential
addresses of Member of the House of Lords it is not information to which
parts 1 to 5 of the Freedom of Information Act 2000 apply. The Freedom of
Information (Parliament and National Assembly for Wales) Order 2008 (S.I.
2008/1967) amends schedule 1 of the Act to state that the House of Lords
is a public authority in respect of information other than—

“...information relating to any residential address of a member of
either House of Parliament...” This means that information relating to
an address of a Member is not subject to a request under the 2000 Act.

Although this is the case, information relating to Members expenses and
the new allowance system which came into effect in October 2010 is
published on the Parliamentary website

This publication includes a column detailing the location of the Members
registered address, this is an optional field, however in the most recent
publication six Members opted to state that they reside overseas and this
remains to be the case. This information is therefore already in the
public domain.

The Finance department has also confirmed that one additional Member has
registered an overseas address but chose not to complete the optional
field for the online publication.

In addition to the seven Members referred to above you may wish to be
aware that Members may choose not to claim financial support in which case
they would not be required to register an address for the payment of
travel related expenses.

You may, if dissatisfied with the treatment of your request for
information, ask the House of Lords to conduct an internal review.
Requests for an internal review should be addressed to

of Lords, London SW1A 0PW. Arrangements will be made for someone who has
not been involved in dealing with your request to conduct an internal
review. Our aim is to complete internal reviews within 20 working days.

If, following this review, you remain dissatisfied with the House’s
treatment of your request for information then you may take your complaint
to the Information Commissioner at Wycliffe House, Water Lane, Wilmslow,
Cheshire. SK9 5AF.
