Request for information under the Freedom of Information Act 2000
Further to your enquiry of 22 May 2019, in which you request the
disclosure of information under the provisions of the above Act, we are
now in a position to respond.
Lancashire County Council does not hold a list of registered common land
and village greens. All land which is registered as common land or a
village green is listed in our Common Land and Village Green Registers
which are held in Lancashire Archives at Bow Lane in Preston. The
registers are available for the public to view and we have included a link
to the Archives pages on the county council's website.
For your information, the 1965 Act was repealed and a new Act was brought
in in 2006. All entries in the register are dated so this date would show
you which Act it was under. Please also note that the Lancashire Archives
will only contain information relating to land within the borders of
Lancashire and we do not have access to information on other counties.
To compile a list of common land/village greens registered under the 1965
Act, we would have to manually go through each register to check when the
land was registered. This would incur a commitment of resources in excess
of the limit of £450 set by the Freedom of Information and Data Protection
(Appropriate Limit and Fees) Regulations 2004 (SI No. 3244 of 2004), which
equates to 18 hours of work. Section 12(1) of the Freedom of Information
Act provides that a public authority is not obliged to comply with a
request where to do so would exceed such a limit.
Unfortunately, given the way in which the information is held, it is not
possible to suggest a way in which your request could be narrowed in scope
to bring it within the limit explained above whilst still yielding
meaningful results. However, if you wish to resubmit a modified request we
shall of course consider whether it is possible to complete within the
