REGINA

ALAN DAVIES, RICHARD EVANS, INDRAVADEN PATEL, COLOMBUS UDOKORO,MICHELE McKENZIE and MARTIN DAY

Case Ref: T20127252

The case was heard at Southwark Crown Court in 2013 where charges were withdrawn against 6 defendants and 1 defendant pleaded guilty to false accounting.

I would like to know:

1. How much money did the overall Prosecution cost?
2. On what grounds were the charges withdrawn against the other defendants? (eg Crown offering no evidence, Public interest etc?)

Thank you for your email of the 30 January 2020 in which you request the
date case papers were destroyed and evidence of their destruction.
 
As previously indicated the case file in relation to the criminal
proceedings is no longer held by the Crown Prosecution Service (CPS).  We
can advise that the destruction date for the case file was 2016, however
no records are held to show the exact date the case papers were destroyed
and no proof of destruction is kept.
 
If you are not satisfied with this response you have the right to request
an internal review by responding in writing to the address below within
two months of the date of this response. The internal review will be
handled by a member of CPS staff who has not been involved with your
original request.

I am writing to request an internal review of Crown Prosecution Service's handling of my FOI request 'REGINA -v A Davies, R Evans, I Patel, C Udokoro, M McKenzie and M Day'.

I note in your response that you state:

"We can advise that the destruction date for the case file was 2016, however
no records are held to show the exact date the case papers were destroyed
and no proof of destruction is kept."

In effect, you do not know if the information requested was actually destroyed and that you only assume that it was destroyed without any proof of the assertion you make.

I would ask that you categorically confirm that the data was either destroyed, with our without a destruction log or certificate, or that the information requested may actually still exist in the absence of documentary proof.
