Dear FOI Officer - Lynn Morley.,

I'm slightly confused about your interpretation of the 'Freedom Of Information Act 2000'.

This request was for the 'National College for Leadership
of Schools and Children's Services' and was regarding information your institution held upon one of your former employees. This was not a request for Mr Lutfur Ali but about information you held on Mr Lutfur Ali a past employee. I assume Mr Ali does not have his own Freedom Of Information Officer employed by him nor requires one. As you can imagine I'm totally confused as to why you would contact Mr Ali in the process of dealing with this request. I find no mention of having to contact former employees before carrying out FOI requests within the FOI Act, and when it comes to legal advice the only legal advice you should be consulting or waiting for is your own institutions, not private outside interests. In my opinion this sort of behaviour is in direct contravention of the Act.

Please could you clarify under what directions set out by clauses within the 'Freedom Of Information Act 2000' that your own FOI department felt the need to contact this gentleman. Please enlighten me on this as i fail to see anywhere with the Act that you are directed to contact the person, checking if they are seeking legal advice, before responding to the request.

Again I reiterate the nature of my original request in that it was a request to be dealt with by your institution, ultimately your FOI office, and the information held by your institution. This was not asking for information held by Mr Ali, and should never have been directed to him, it was a request about information held by yourselves, regarding Mr Ali.

Please could you contact me back as soon as possible to clarify your intentions and which part of the FOI Act 2000 which you were following which directed you to directly contact your former employee, Mr Lutfur Ali.
