reg. 23 of The Representation of the People (England and Wales) Regulations 2001

The request was successful.

Dear Winchester City Council,

Please could you tell me, (in each of the last 10 years) how many prosecutions have been undertaken for failure to comply with reg. 23 of The Representation of the People (England and Wales) Regulations 2001?

What is the authorities policy with regard to whether a prosecution is pursued or not?

Yours faithfully,

James Alexander

Dear Winchester City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Winchester City Council's handling of my FOI request 'reg. 23 of The Representation of the People (England and Wales) Regulations 2001'.

The authority has failed to provided the information within the time limits set down by the FOI act, and is generally unresponsive.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/r...

Yours faithfully

Winchester City Council

Those seeking information held by ERO's or returning officers, might find para. 18 of the following decision useful to have in mind.

https://ico.org.uk/media/action-weve-tak...

"The Commissioner agrees that information held purely by or on behalf of the returning officer would be information which would not be held by the council for the purposes of the Act. However if that information was also held by the council for its own purposes then it would be held by the council for the purposes of the Act. "
