Refusal of DPA Subject Access Requests

This is a formal request for information under the Freedom of Information Act.

For the years 2005 to date, pleas provide the following information, broken down by year and as percentages.

1) The number of Subject Access Requests received by the trust annually.

a. How many were fully complied with, within the 21 day NHS guidelines.

b. How many were fully complied with, within the 40 day statutory timescale

c. How many required "additional information" and were them completed within the 40 day statutory timescale

d. How many required "additional information" and then were formally discontinued by the applicant

e. How many required "additional information" and then were informally discontinued by the trust due to the applicant not responding to the request.

f. How many were refused before the 21 day point, and break down the reasons for refusal.

g. How many were refused before the 40 day statutory timescale, and break down the reasons for refusal.

h. How many were refused after the 40 day timescale, and break down the reasons for refusal.

2. Of the above SARs, please break down in percentages how many were for medical records, and how many in relation to other matters. This need not be annualised.

3. Of the above SARs, how many refused requests were instigated by a patients representative.This need not be annualised.

4. Please provide sample copies of your "Refusal", "Additional Information" and "Letter of authority" letters or forms as required for each of the years in question and for each of the trusts.

Please note that this request extends to the Current Trust, as well as to the Basingstoke and North Hampshire Trust and the Winchester and Eastleigh Trust prior to the formation of the Hampshire Hospitals NHS Foundation trust.

Please note that section 8.1.b of the Freedom of Information Act asks for an "address for correspondence", and that the email address I am using is sufficient according to the ICO guidelines. http://www.ico.gov.uk/for_organisations/...

I will not, therefore, be providing you with a street address for correspondence and expect your compliance with the Act in that regard.

Under section 11 of the Act, I confirm my willingness to receive information electronically.

Any reply will be relied upon in prospective or current proceedings against the trust. Any refusal to provide this information will be referred to the Information Commissioner.

I require this on the basis that such involvement might cause me, or a person whom I represent, harassment, alarm or distress, and that such distress is unwarranted.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Hampshire Hospitals NHS Foundation Trust's handling of my FOI request 'Refusal of DPA Subject Access Requests'.

I believe the time estimate and cost estimate given for the work needed to complete this request and supply all of the information is incorrect.

The trust has stated that the cost (£450) amounts to 2.5 days work. However, at £10 per hour, this would be 45 hours work. At minimum wage, this would be closer to 80 hours. This does not match the 2.5 day claim made by the trust.

I note as well that you state this request went through your legal department. I made my position clear; Ms [last name removed] was not to be involved in the Request. It is clear that she has been.

Please supply the additional information required within no more than 20 days and explain why Ms [last name removed] was involved in the request.

Should you fail to acknowledge this request in a timely manner, or comply with the timescale set out, I will refer this matter to the Information Commissioner.
