Under the Freedom of Information Act 2000, I believe the above properties are being used to house refugees.

I therefore would like to know the following:

- [ ] How much is each respective landlord being paid (monthly) for each property for housing the refugees ?
- [ ] What authority is paying the landlord?
- [ ] Is the landlord being paid per person or a monthly rental income? Please provide figures if per person at each of the above properties? If the payment is a monthly rental is this capped by LHA?
- [ ] How much is being paid (monthly) for the utilities consumed by the refugees (Gas, electricity and water) - Who is paying for the utilities used?
- [ ] Is each refugee receiving a living allowance, if so how is being paid to each refugee?
- [ ] How many refugees are being housed in each of the properties mentioned? What are their nationalities (if this cannot be provided, the continent of origin will suffice). What is the age or estimated age of each person?
- [ ] I noticed damage to the property at [address removed], I therefore wish to know what deliberate damage has been caused to the property by the occupiers at each property, including the cost to make good?
- [ ] I wish to know what routine maintenance work has been carried out, please list and the cost. I noticed a boiler replacement and a window pane being replaced at [address removed].
- [ ] Are the houses being inspected by the authority for damage caused by those occupying them?
- [ ] Do the refugees have support workers and what level of support is being provided? When are the refugees going to be integrated into British life? Are they going to school/college/looking for work?
- [ ] How long are the properties going to be leased to house refugees?
- [ ] Why are these properties not being used to house British families in need and refugee families with children who would benefit with these types of accommodation?
- [ ] As the houses are not being used to house families and are properties in multiple occupation, has planning permission being sought for change of use? I would like to see copies of the applications. If no planning has being sought, I wish to know why, as I believe each room is being occupied and therefore requires planning.
- [ ] If the properties are to be returned back to their respective owner, what would be the current cost to make good each property?
- [ ] Have neighbours been informed beforehand of the intention to house refugees and what stipulations? Are the refugees given a contract regarding their behaviours i.e loud music etc as part of their tenancy agreement - If so, I would like a copy of the contract and a contact who to report any such incidents. I wish to see any objections and letters of complaint, under s.40(2) I am aware personal details will be redacted?
- [ ] I would like to know who is responsible to furnish the properties, the costs of white goods, beds, crockery, providing clothing? Are the goods new or pre-owned?
- [ ] How many refugee properties are now being used in Medway? I would like a breakdown by family , or single same sex house share?

If any of my questions breach s.12 of the act, please advise me under s.16 how to get my request in scope. I believe the questions will NOT breach the cost element.

I am writing to request an internal review of Medway Council's handling of my FOI request 'Refugee Housing'.

I find this information is in the public interest and some questions could have been answered i.e the aspect regarding the change of dwelling from single to house in multiple occupation.

Therefore, if this is required by law, a planning application would have had to be made, therefore the status of the properties are held for the public to view and therefore not exempt under 'confirm or deny'.

Also a contact name for their support office cannot be disclosed??

I therefore ask for a internal review and request you to provide more information regarding Q17.

You mention with regards to Q17 that other LA,s may put refugees in Medway without informing MC. But the refugees will be using resources paid by Medway rate payers, so information must be held?

Finally, this can be treated as a new request if you wish - I would like to know if MC have a budget for refugees and so a break down of the total 2016/17 allocation and its expenditure to date.

With regards to the properties mentioned, please provide the status of the properties single dwelling or are they homes in multiple occupation.

I am writing to request an internal review of Medway Council's handling of my IR FOI request 'Refugee Housing'.

With regards to Q13 you mention under s21 you have sent me a link to the planning portal to search for such planning applications.

I must remind you that the ICO states you 'must provide advice and assistance'.
I appear to be having difficulties locating these applications for the change of status from single dwelling to HMO's. I therefore ask you to provide assistance in providing me with the relevant MC/??/???? references for these applications.

I believe you are trying to mislead me, as I have tried a basic search and there are NO applications been made.

I therefore wish to know if the above is true, why no enforcement action has been taken over these HMO's as the occupants are not related and are same sex occupants.

If the properties are exempt from planning because of the properties refugee status, I would like to know to which part of law this falls under.

Also, I mentioned in my previous response about a 'refugee budget', I don't appear to have received a response for this?

If you continue to be aversive with your response, I will make a complaint to the ICO with regards to the lack of transparency.

I refer to your email of 18 October 2016, below, please accept my apologies, other commitments have prevented me from responding sooner. I have addressed your enquiry below, however, please be aware I am only able to address your concerns with regards to your request for information, any other concerns i.e. a possible breach relating to HMO status, must be directed to the relevant departments as detailed in my response.

I advised that all planning applications received by the Council are available on the Council's website and provided you with a link. You state you have conducted a search and cannot find any applications for the properties mentioned, therefore, I can only suggest that no applications have been made.

Let me assure you there is no attempt to mislead you, S21 enables a local authority to refuse a request because the information is available to you by other means, i.e. planning applications are published on our website. This was not an implication that applications exist, simply that if they do exist that is where you would find them.

I have addressed your request for an internal review of your request for information, however, your letter asks for additional information in relation to the planning status of the properties. If there are no planning applications in relation to these properties, then it may be safe to assume they do not have HMO status. As explained in my letter, enforcement action may be taken if the Council is not notified of HMO status, therefore, I suggest you make a complaint regarding a possible HMO breach via the link to 'Planning Enforcement', which I provided in my previous email, to enable that department to follow due process and investigate the matter further.

I was unaware that your further enquiry regarding a budget for refugees had not been dealt with, please accept my apologies for this oversight, I have requested that it is logged as a new request.

Please be aware that an individuals status, refugee or otherwise, is their personal data and as such we can neither confirm nor deny the status of a property, if it would reveal personal data about the occupants, therefore, there is no lack of transparency, we are simply complying with the Data Protection Act 1998.

omitted to advise you whether Medway Council held any budget for refugees,
we raised a secondary request for you to respond to this question,
unfortunately due to unforeseen circumstances within the Information
Governance team, Medway Council has, until today, been unable to respond
to you.

 

We offer our sincere apologies for the lateness in our reply to your
question : I would like to know if MC have a budget for refugees and so a

Medway Council does not hold a budget for refugees.
