Freedom of Information Request (Ref: 16152)

 

I refer to the above and your request dated 23, March 2016. I have
contacted the relevant services and now provide a response to the
following request Tender Pack - Bread - Pricing Schedules received.

 

Could you please share the responses received? In particular I would be
interested in the Pricing Schedules received

 

The Procurement A2WD-L8KA3Z Fresh Bread and Morning Goods is still under
evaluation, and as such we cannot release any details until the process is
complete.

 

However, we do not provide submitted pricing schedules from procurements
as these are commercially confidential documents to those organisations
who submitted them. Additionally we do not normally provide any
information from unsuccessful tender submissions.  Section 43(2) of the
Freedom of Information Act provides that information is exempt from
disclosure to the extent that disclosure would, or would be likely to,
prejudice the commercial interests of any person.

 

As information would be exempted under Section 43 (2) of the act, a
public interest test applies. This involves weighing the balance of public
interest in maintaining the exemption or releasing the information. 
The council understands that there is public
interest in promoting the transparency and in the accountability and
scrutiny of how public money is spent.  The Council does not consider
there to be a strong public interest in releasing the details contained
within the tender (pricing schedules) as there is a significant risk that
this could prejudice the service and/or have financial implications to the
company providing the tender, the
public interest is best served by maintaining the exemption in respect of
the information.

 

I trust that this response is satisfactory. If however you are
dissatisfied with this response you have a right to appeal to an
independent officer within Corporate Information Governance. They will
re-examine your request and assess whether we have adhered to the
requirements of the act. Should you wish to follow this course of action
please address your concerns in writing to Saleem Aziz, Corporate

You also have a right under Section 50 of the Freedom of Information Act
