Dear Dorset Council,
Under the Freedom of Information Act, I would like to request the following information regarding paper and cardboard recycling in your borough:
• What are the contractual performance KPI's for this contract?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Who is the current supplier?
• Actual spend on this contract/framework (and any sub lots), from the start of the contract to the current date
• Are there any processing facilities or MRFs utilised within the contract if so what the names and addresses?
• How is your fibre processed (baled or loose)?
• Where is the end destination of the fibre?
• What is your current collection method (dual stream, single source, kerbside sort or comingled)
• What tonnage per year do you produce by fibre grade?
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?
• Are there any plans to change the existing service?

Thank you for your information request dated 06/03/2024, which has been
dealt with under the Environmental Information Regulations 2004 (EIR). The
EIR is broadly the same as the Freedom of Information Act but covers
requests for information about the environment and environmental matters.
Our response to your request is as follows:
• What are the contractual performance KPI's for this contract?
Paper and cardboard recycling forms part of the existing Resource
Management and Transport Contract whereby the Contractor is required to
sell recyclate materials collected by the waste authority. The paper and
cardboard are those mixed with the kerbside collection service: [1]Which
bin do I use - Dorset Council. Paper and cardboard collected through
Household Recycling Centres, which is under the same contract, is the
property of the Contractor and sold at their discretion.
The KPI’s applicable are between the council’s contractor and the
reprocessor.
• Suppliers who applied for inclusion on each framework/contract and were

PQQ – Hills, EWC & W&S Recycling Ltd
ITT – EWC & W&S Recycling Ltd
• Who is the current supplier?
W&S Waste Management (previously W&S Recycling Ltd)
• Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date
Circa £50m (based on £600,000 per month since August 2016). This is for
all services under this contract.
• Are there any processing facilities or MRFs utilised within the contract
if so what the names and addresses?
The current Materials Recycling Facility (MRF) used under this contract is
Shotton Mill Ltd Weighbridge Road, Deeside Industrial Park, Deeside CH5
2LW
• How is your fibre processed (baled or loose)?
The fibre is sent loose to the MRF
• Where is the end destination of the fibre?
Shotton Mill Ltd
• What is your current collection method (dual stream, single source,
kerbside sort or comingled)
Comingled
• What tonnage per year do you produce by fibre grade?
In 2022/23 a total of 26,886 tonnes of comingled material was sent to the
MRF of which it is reported that 22% is News & Pams, 23% is mixed paper
and 20% Cardboard.
• Start date & duration of framework/contract?

given to all bidders for when this contract was last advertised?

• Who is the senior officer (outside of procurement) responsible for this
contract?
We have withheld third party personal data as this is exempt from
disclosure under Regulation 13(1) of the EIR, pertaining to Data
Protection. This information includes the name and job title of the
member of staff at Dorset Council, because they are below Senior
Management level. The information in question is enough to make these
individuals personally identifiable. Article 5(1)(a) of the UK General
Data Protection Regulation (GDPR) states that personal data shall be:
processed lawfully, fairly and in a transparent manner in relation to the
data subject (‘lawfulness, fairness and transparency’)
Under Article 6(1)(f) of the GDPR, processing of personal data is only
lawful to the extent that:
processing is necessary for the purposes of the legitimate interests
pursued by the controller or by a third party, except where such interests
are overridden by the interests or fundamental rights and freedoms of the
data subject which require protection of personal data, in particular
where the data subject is a child.
In this case it is not considered lawful, fair and transparent to disclose
the personal data in question. Disclosure would breach Article 5(1)(a) of
the GDPR because it would be against the reasonable expectations of the
individuals, it would create a loss of privacy which they would not
otherwise expect to occur, and their consent has not been given to
disclose their information outside of the Council.
Furthermore, the processing of the personal data does not meet the
criteria of Article 6(1)(f) of the GDPR (‘legitimate interests’) because
there is not a legitimate interest in disclosure of the personal data,
disclosure is not necessary for the purposes of the legitimate interest,
and the legitimate interest does not outweigh the interests and privacy
rights of the individuals concerned.
• Are there any plans to change the existing service?
Not at this time, but future contractual arrangements will be considered
in due course as appropriate
