Dear Mr Murray,

 

FREEDOM OF INFORMATION REQUEST

 

I am writing to advise you that the time limit for responding to your
request for information which the Agency received on 03 December 2012
needs to be extended.

 

In accordance with section 10(2) of FOIA I am extending the 20 working day
time limit for issuing a response by a further 20 working days. The
information being considered as exempt from disclosure under section 36
(2)(c) (prejudice to the effective conduct of public affairs) of the Act. 
However, the exemption may be set aside if it is decided that the public
interest in disclosing the information outweighs the public interest in
withholding it.  The extension is to enable us to consider this public
interest test.

 

I hope to let you have a response by 31 January. If you do not receive my
response or further information by then, please contact me and I will
investigate the matter.

Information requested under the Freedom of Information Act (FoIA)

 

Further to our email of 3 January, I can confirm that we have handled your
request for information about recruitment guidelines and policies for
driving examiner recruitment and assessment centres within the terms of
the FoIA.

 

Please find attached the following documents:

 

o Annex A – recruitment guide for hiring managers
o Annex B – recruitment applicants guide
o Annex C – recruitment principles
o Annex D - copies of two assessor’s guides

 

I can confirm that we hold additional information about what would be
classed as positive and negative behaviours which is contained within the
assessor’s guides (Annex D) but this is being withheld under section
36(2)(c) on the grounds that its disclosure would prejudice to the
effective conduct of public affairs.  This is a view certified by the
Minister and then subject to the public interest test as to whether the
balance lies in favour of withholding or disclosing the information.  We
have concluded, applying a presumption in favour of disclosure, and in all
the circumstances of the case, the public interest in maintaining the
exemption outweighs the public interest in disclosing the information. 

 

Annex E of this letter sets out the exemption in full, as well as the
factors we have considered when deciding where the public interest lay.

ask for an internal review by contacting the Information Compliance
