Extension of time

I am writing to advise you that the time limit for responding to your
request for information under the Environmental Information Regulations
2004, which we received on 13 September 2021, needs to be extended.

The Regulations allow us 20 working days to respond to your request from
the date of its receipt. However, it is occasionally necessary to extend
the 20 working day time limit for issuing a response. In this case, I

I am writing to request an internal review of part of your response.

I would like a review of the decision to apply the 'internal communications' exemption to part 5 of my request.

This is a qualified exception. You have not provided any details as to why this exemption has been engaged. Even if this exception is engaged,my understand is that you must undertake the public interest test set out in regulation 12(1)(b).

Furthermore, as you wil be aware, a public authority can only withhold the information if the public interest
in maintaining the exception outweighs the public interest in disclosing the information.

It is also the case that Regulation 12(2) specifically states that a public authority shall apply a presumption in favour of disclosure.
