Dear Oxford City Council,

I am writing to request details of all records of the existence of mould, moisture/condensation and/or dampness at flats 1-11, 13-23 Friars Wharf and in particular any information about these issues occurring or being reported to exist at 17 and/or 19 Friars Wharf. Likewise, I would like any information or reports of instances of mould, moisture/condensation and/or dampness at the adjoining houses at 25-37 Friars Wharf.

In each case, this should include though not be limited to any reporting of these issues by tenants or owners and what was actions were taken to rectify this, and any surveys carried out by Oxford City Council or any other party or contract working on behalf of the council or known to the council.

In addition, I am also requesting details of any information or reports concerning the design and construction of the flats/houses in this development, and specifically any information and/or reports that mention or allude to any problems related to their design and/or construction and any longer-term consequences of this in respect of a) ongoing problems relating to the fabric of the properties at these addresses and b) impact or potential impact of such issues on the health and well being of the occupants.

I refer to the acknowledgement below.  I can respond to your FOI request
received on 6^th March 2015 as follows :

 

Having considered your request, I think that to provide the information
that you are seeking will result in the time limit allowed under s12 of
the Freedom of Information Act 2000 (which equates to about 18.5 hours per
request) being exceeded.  Several files and various officers’ email
accounts will have to be checked to find the information.  The documents
will have to be read to see whether they should be disclosed or withheld,
and, where necessary, the appropriate Freedom of Information Act
exemptions applied.  For example, the documents could contain personal
data, which would be exempt from disclosure under s40 of the Freedom of
Information Act 2000.

 

If it is possible for you to refine your request, for example, by limiting
the number of properties, so that the time limit is not exceeded, I will
consider the matter further.

 

If you disagree with any part of the response to your request, you are
entitled to ask the Council for an internal review of the decision(s)
made.  You may do this by writing to the Monitoring Officer, by either
email – [1][email address] – or by post to Monitoring Officer,

Thank you for your response to my FOI request.

I note that you took until the day of the deadline to tell me that you needed further clarification.

1. Can you tell me if the delay is in any way related to with the formal complaint I lodged against Oxford City Council on 23 March, concerning the ongoing situation re recurrent mould at 17 Friars Wharf (and also 21 Friars Wharf)?

2. You mentioned the length of time you estimated it would take the Council to search for the information I requested. On 11 March this year the Leader of Oxford City Council, Bob Price assured me, having taken less than a morning to conduct a search of the same addresses I listed in my request,that there had been no reports of mould or dampness in any of these properties, other than number 1 Friars Wharf . Am I to understand from your response that Mr Price was therefore not in a position to provide such an assurance or that he could not possibly have carried out the search in such a short period of time?

3. If that is the case and you do indeed require me to narrow down the number of addresses, can you please provide the information I requested in relation to flats 13-23?

4. Can you assure me that your failure to give the information I requested, and in particular your reference to possible personal details that would allow for the withholding of information, is in no way linked to the upcoming General Election and in particular on the Labour Party in the area's references in its campaign publicity to Oxford City Council's record of providing 'high quality housing'?

Finally, I note in sending this reply that I was informed yesterday that you yourself would also be responding to my formal complaint - which I understand still to be the case despite my having raised concerns about potential conflicts of interest.

Thank you for your email below to which I can respond as follows:

 

1.    The time taken to deal with your FOI request was not related to the
formal complaint that you lodged on 23^rd March 2015.

2.    The FOI request that you submitted was more wide ranging than
reports of mould or dampness in 1-37 (odd) Friars Wharf.  You also
requested information about the design and construction of the properties
in the development.  This would require far more extensive research, hence
my application of s12 of the Freedom of Information Act 2000.  I
understand that Councillor Price said that he would check his records of
reports of damp problems in the block, which he did.

3.    I will treat this as a new request under the Freedom of Information
Act.  I will provide you with information in respect of mould and damp
reports for 13-23 (odd) Friars Wharf within the FOI timescale.

4.    I can assure that there is no link between the response to your FOI
request and the upcoming General Election.  The personal data that would
be exempt from disclosure relates to third parties.
