Dear Charity Commission for England and Wales,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Charity Commission for England and Wales's handling of my FOI request 'Records of Barry Arts Centre'.

I am requesting an internal review, with particular focus on the public interest test, which I think has overlooked some important points in favour of disclosure of the information request.

The person public interest test focussed on the contents of the regulatory corresponsedence as if, at this stage, disclosure of that correspondence has been requested. It had not.

He or she completely missed the point that the information itself was NOT what was asked for.. Instead what was asked for was a LIST of the information held by the Commission. A mere title need not necessarily disclose exempt information contatined in a document.

Furthermore even if it did, it may be possible to redact exempt information.

In addition the person refusing the request stated that only "some" of the information was exempt, yet chose to withhold all of it.

The public interest clearly favours the public being able to know what sorts of information are held by a public authority, even where parts of the information need to be redacted.

The public interest also favours a presumption of disclosure, not a presumption of withholding. In any event, what was asked for was a list of information held, not the information itself.
