Dear Mr Chris,

 

Thank you for your enquiry, which has been forwarded to the appropriate
officers for a response. The usual timescale for a response is twenty
working days, that is by or on 27.06.17.

 

If for any reason the Council needs to extend this timescale you will be
notified in accordance with the relevant legislation.

 

Please note that in 2012 the County Council adopted a position in
principle that FoI and EIR requests to West Sussex County Council and the
Council's responses may be published on the Council's website in a
suitably anonymised form. This is in addition to the individual response
to the requestor, and in line with the Council's commitment to
transparency and open data.

I refer to your request dated 28^th May 2017, which has been dealt with
under the Freedom of Information Act 2000.

 

Your request was for information identifying the different government and
non-government departments and agencies West Sussex County Council informs
of a record of birth after the birth is recorded.

 

We have now completed a search for the information which you requested and
I confirm the Authority holds information relevant to the request.

 

Registration officers are statutory officers with no common law powers to
share data. Any data sharing arrangement must therefore rely on an
explicit legal power i.e. a legal gateway, that is also in accordance with
the purposes set out in the legislation. The requirement for a
registration officer to release information, obtained as part of
registration duties, applies equally to personal and non-personal data and
must also meet the DPA principles (covered in MD1.8).  As part of their
statutory duties, registrars and superintendent registrars are required by
law to collect certain particulars which may only be shared through these
legal gateways.  With regard to birth registrations, these legal gateways
are in place for the departments listed below:

 

 

·         Local Education Authority - S564(3) Education Act 1996

 

·         National Health Service Commissioning Board - S269(2) National
Health Service Act 2006
