Response to this request is long overdue. By law, under all circumstances, Lancashire Constabulary should have responded by now (details). You can complain by requesting an internal review.

Dear Lancashire Constabulary,

When recording a complaint, Lancashire Police must first make a decision of whether the complaint is Local Resolution or Local Investigation.

The IPCC has set out guideline for how this decision is made, in a nutshell, if the allegation is proven, would there be any likely misconduct or criminal charges.

This decision is made without looking at any evidence and must be made by an appropriate authority based on the allegation alone.

It is my experience that decision is wrong on far to many occasions.

What I want to know is, what is the process for making the decision?
What is the police process for rectifying a decision 'made in error'.
Who is the ultimate authority for overlooking PSD to ensure they have not abused the power to give an incorrect classification.

To clarify, an LR (Local resolution) complaint has outcome of misconduct against the officer involved so it is believed that this is a 'default' by PSD in an attempt to avoid misconduct or criminal charges being brought against officers where possible.

Local Resolution complaints do not have the right to appeal to the IPCC.

Who is the correct authority to report this abuse of process and what is the correct format to raise it.

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under your Section 16 obligations, as to how I can refine my request to be included in the scope of the Act. In any case, if you can identify ways that my request could be refined please provide further advice and assistance to indicate this.

All information request I have made are my right to information. This particular request is very relevant to a legal case I have against Lancashire Constabulary and your refusal to answer is clear that you are unable to without incriminating yourself for decision you have made, namely a refusal to record a complaint as a Local Investigation where Lancashire Police officer ASSAULTED me and this was ruled by magistrates as the officer acting unlawfully.

My request still stands and I do require this information. Should you fail to provide it, I will report this to the ICO.

You have also disclosed some information about me on this public request, I will also be asking the ICO to investigate this.

Dear Information assurance unit,

I write, for the record, as you have disclosed personal information about me.

I have many complaints against Lancashire police, simply because Lancashire police defended Paul Turner, a Police informer, from attacking me family and I. He threatened to kill my wife and children, yet you did noting to prosecute him. He made dozens of malicious and false accusations calling me a paedophile, you did nothing. I complained at every event, you now try to turn this around like I have done something wrong!

You then arrested ME, for nothing. The Magistrate said YOU acted unlawfully. You ten pepper sprayed me, stripped me naked and sexually and physically assaulted me. I suffered sever chest pains and even during that, I was assaulted, caught on your CCTV. I ended up on a cardiac ward for two days after your treatment of me! YES, I complained, because you tried to prosecute me for NOTHING, No CPS advice, just police trying to defend a snitch and framing me. Magistrates acquitted me, I did nothing wrong and ruled YOU acted UNLAWFULLY. Yes, that is the Police acting unlawfully, not me. So, yes, I complained and you refused to investigate. So I complained again and now you say I am vexatious... I am the victim, you attacked me and refused to obey the magistrate who said you acted unlawfully. So, this is why I want the answer to this question, and you WILL answer it. It is NOT vexatious as you say, I am seeking justice for what YOU did to me.
You have done NOTHING for my family, absolutely NOTHING. Not only that, you try to make out you are whiter than white when it is you that is vexatious an I will never stop seeking justice.

Dear Lancashire Constabulary,

I am writing to request an internal review of Lancashire Constabulary's handling of my FOI request 'Recording of Complaints either Local Resolution or Local Investigation'.

This is a genuine request for information but has been branded vexatious for no reason other than to discriminate against me.

The information I require is relative to a complaint that is currently under investigation.

This is a serious allegation against Lancashire police for assault, this included the use of a firearm and was ruled unlawful by a magistrate, I have requested information relating to this unlawful arrest and how it was subsequently handled.

I have the right to request this information and by law you must provide it. Please can yo do so as soon as possible.
