Recorded definition of "breach of ther peace".

L : Turnbull made this Freedom of Information request to Ministry of Justice

This request has been closed to new correspondence. Contact us if you think it should be reopened.

Waiting for an internal review by Ministry of Justice of their handling of this request.

Dear Ministry of Justice,
my oxford law dictionary defines breach of the peace as "a state that occurs when harm is done or is likely to be done to a person or (in his presence) his property, or when a person is in fear of harm through assault, affray, or other disturbance".
Can you give me the legal Ministry of Justice definition of breach of the peace if it differs from the oxford one, please? The oxford one seems a bit limited in scope of application for a breach of the peace.
Thank you for your time on this.

Yours faithfully,

L : Turnbull

I was just about to ask the MoJ the same thing, thanks for asking!

It seems that they should have answered by now and are breaking the law.

Would you mind writing back to the MoJ (link above) and ask for an internal review. There's some buttons to click up there :o)

Be interested in their answer for sure. Seem likes a very vague, undefined, get in jail free card for everyone. A proper definition is required in order that people can keep the peace.

Dear Ministry of Justice,
I really did think that this was such a basic question that you could have answered very easily and quickly. If there is a problem associated with the release of this information would you please tell me.
Can you not just look up one of the usual dictionaries that you usually rely on?

Yours faithfully,

L : Turnbull

Dear Data Access & Compliance Unit,
you have asked me for a case reference number in order to track the request I made about the definition of breach of the peace - which is really quite late in being answered. Where do I find a case number?

Yours sincerely,

L : Turnbull

FOI requests are amazing.
Who would have thought that such a small thing could have revealed so much injustice by the orwellian ministry of justice? Clearly justice is no concern of their's, unless justice is doublethink for an entirely different concept.
Their arrogance is staggering- and very revealing.

The series of automated responses you have received is unhelpful. I'm surprised that you didn't get a simple refusal on the grounds that the information was either not held by the Ministry or was readily available elsewhere.
The Ministry of Justice is part of the Government and has an executive/administrative function rather than a judicial one. Accordingly, I doubt that they hold a definition of 'breach of the peace' as part if the core function of administration although they may have a library containing books which contain the definition you are interested in. Of course you could go to a library and look up the topic if you wanted to.

Unbelievable.
