1.    I politely request a record of all Council Officers' checks made at
each critical stage of all the demolition / building work undertaken in
Avebury Road, Westcliff-on-Sea, Essex for the period 2014 to present (
24th November 2016 ).

 

I can confirm that a search for the information has been completed.

 

1.    Details of all planning applications (and some Building Control
information) are available to view on our website at
[1]www.southend.gov.uk/publicaccess. Therefore, unfortunately the
information requested is exempt under Section 21 of the Freedom of
Information Act ‘Information Accessible to applicant by other means’.
Planning Files are covered under the Local Government Access to
Information Act 1985 and are public documents. However, please see below
list of application numbers in relation to the address above, if you enter
the reference number in the search all supporting documents are available
online.

Firstly, may I please apologise for the delay in my reply but I have been in Australia for rest and recuperation as advised by my Doctor.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Southend on Sea Borough Council's handling of my FOI request 'Record of checks made by Southend Council on all stages of Building work held in Avebury Road.'.

I respectfully list below, in my own opinion, the legitimate reasons for requesting this review :-

1. Misleading references and incorrect guidance given on how to obtain the information that I requested, not via FOI channels but directly from the Southend Borough Council web-site ( please see excerpts below from my own reference document, available upon request, that I hold electronically complete with evidential screenshots ) :

Search 2. 16/00816 – refers to an address in Shoeburyness SS3 9JP ( 21 Cranley Gardens ).
Search 3. BC/16/00782/IN - No results found despite several different searches.
Search 4. 16/00782 – refers to an address in Leigh-On-Sea, SS9 1LW ( 24 Woodleigh Park Drive ).
Search 5. BC/ 15/00147/IN ( formatting taken direct from reply to my FOI request ) - No results found despite several different searches. I also tried BC/15/00147/IN with the space removed but still the same > No results found.
Search 6. 15/00147 – refers to an address in Eastwood, SS9 5PG ( 29 Brookfields ).

" Yet your very own web-site at http://www.southend.gov.uk/info/200154/b... advises that " Building Control is to make sure that all building work complies with the Building Regulations and other allied legislation. This is done by checking the plans of the proposed work and by inspecting the work on site.
………Usually you must notify us when building work is to be carried out. Not all new buildings must comply with the Building Regulations. ……………

…………….Please see the Make a Building Regulations Application page if you wish to make a submission. Once you have submitted an application, a Building Control Officer will inspect the building work. Once the officer assesses whether the work complies with the Regulations, they will issue a Completion Certificate…….".

Further substantial corroboration, showing that it is the Council themselves who are also responsible for the control and governance of the Building Control Inspections, is detailed within :

" Request Building Work Inspection.......If you would like to arrange for the Building Control team to carry out an inspection of your project please fill in the following form. Please allow 24 hours notice for requests for site inspections.". And..

You should notify us when critical stages of work are ready for inspection. We will then tell you what those stages are for your project when we confirm receipt of your valid application. Please remember that you must notify us at both commencement and completion of the work as well as the critical stages.
To book a site inspection please call 01702 215004. Please note that we require at least 24 hours notice.
You should be aware that the inspections are only carried out to ensure that the building work complies with the Building Regulations. They are not a substitute for day to day supervision of the building work. You will need to employ an independent professional person to supervise builders and deal with contractual matters should this be necessary.".

I am withdrawing this request as :-

1. I feel that I have made my points quite clearly and also made them very strongly, and

2. I am trying to avert any repercussions due to 'private' action(s) by certain third-party ( ie. non-Council related ) aggrieved parties.

I'm hoping that by this and all of the other Freedom of Information requests that I have made ( which I will also be immediately withdrawing ), that somehow and somewhere I have protected some of the Health & Safety of all other citizens of Southend-on-Sea.
