I am writing in response to your email of 22 August 2016, which asked for a review of the handling of your FOI request. I have considered the handling of the request and the response sent to you in accordance with the Code of Practice issued under section 45 of FOIA.

Your request of 24 July 2016 asked:

"Can you tell me how much money your corporation has received from the paid for female and male toilets at King's Cross station in your fiscal 2014-2105?"

Network Rail responded to the request on 27 July 2016; the response was sent promptly and well within the 20 working day statutory deadline, and therefore complies with section 10(1) of FOIA.

The response explained that the information you were seeking was already available on our Transparency Portal and cited the section 21 exemption under FOIA; this is the correct exemption to apply when the requested information is reasonably accessible to the applicant by other means. A link to the Portal was included, and directions to the information were provided in a further footnote. I have followed the link and directions to confirm that this takes you to an Excel spreadsheet entitled 'Toilet Finance Data'; the spreadsheet provides the 'Total Income Received 2014-15' for Network Rail's Managed Stations, including King's Cross.

The response also provided further advice and assistance in the form of several explanatory notes. Included here was an explanation that the overall figure had been provided as you had not asked for separate totals for the female and male toilets; however, the response also invited you to contact us again if it was indeed the case that you wished the figures for the female and the male toilets to be provided separately.

I have considered the wording of your request and whether this was an appropriate response. I consider that your request does not specify that the totals for the female and male toilets should be provided separately, and I agree that one possible reading of the request would be that it simply seeks the combined amount for the female and male toilets. If this is the correct interpretation of your request, then the information to which you were directed satisfies the wording of your request. However, I do note that the Information Commissioner's guidance recommends that if there is any ambiguity about the interpretation of a request then the public authority should seek clarification from the applicant as soon as possible. In this respect, I consider that the advice and assistance included in Network Rail's response effectively sought such clarification from you - the response addressed the possible interpretations of your request, and asked you to contact us if the information already provided was not what you were seeking. This was done within a few days of the receipt of your request and complies with the section 16 duty to assist the applicant.

In conclusion, I consider that your request was appropriately handled and I will therefore close the review at this time; it remains the case that you may of course contact me again if you do wish the revenue from the female and male toilets at King's Cross to be provided as separate figures.
