Receipt of a police report

Dear Crown Office and Procurator Fiscal (Scotland),

when you receive a report from the police service stating a specific offence

1. do you investigate that the police have investigated the matter correctly and have complied with the full written law

2. do you just take their word for the report being lawfully sound

3. if a "defendant" points out errors in the report or alleged offence do you bend, omit, or ignore the written law in favour of the police service

4. how far are you allowed to bend, omit or ignore the written law

5. if you request a court to arrest someone is it your decision or do you pass that to the sheriff clerk

6. Do you have an obligation to uphold the written law

7. if you discover an error with the report of an alleged offence, are you obliged to remedy this error at the first point of discovery, or are you obliged to continue to conviction

8. if you make a unjust legal interpretation of the written law, are you obliged to cover this up in favour of the copfs
