Reasonable Adjustments

The request was partially successful.

Dear Children and Family Court Advisory Support Service,

CAFCASS responding to disability requests for reasonable adjustments
Dear Cafcass customer services

Please supply me with the following information under FOIA :

1. If a disabled service user informs CAFCASS that they cannot communicate their complaints by email or by telephone due to their illness/disability how would Cafcass communicate with the service user to ensure their complaint is fully investigated ?

and

2. Again if a service user has informed Cafcass they can’t communicate their complaint by telephone or email would CAFCASS “accept” their request for s face to face meeting

and
3. Would CAFCASS provide “all reasonable adjustments” requested by the disabled service user?

Yours faithfully,

Samantha Kerr

Dear Children and Family Court Advisory Support Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'Reasonable Adjustments'.

Your practice does not match your policy.

You have not identified the needs of the case, by refusing the needs of the service user, therefore this report cannot child centred, as you effectively removed a disabled service users voice by not allowing a reasonable adjustment under the Equalities Act 2010, and you failed in your statutory duty to comply with the act, by knowingly making written communication even more difficult for the disabled service use by using a Egress encrypted email system, when the service user had already told you she was technologically challenged, no effort was made to uphold your statutory duty as defined by the Equalities Act 2010.

I have no choice to report this as a serious failing on Cafcass’s side as a complaint stage 1 and I have written to the EHRC European Human Rights Centre to advise them of your failure to deliberately uphold your statutory duty in law under the Act.

EHRC Enforcement's include

• ensure that the immediate risk of discrimination is eliminated or reduced. Change the behaviour of the organisation or sector in question to promote and achieve sustained compliance with equality law
• ensure that public and private sector organisations who breach equality laws may be held to account and deter non-compliance

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/r...

Yours faithfully,

Samantha Kerr
