FREEDOM OF INFORMATION REQUEST

 

Thank you for your recent request received by the Council on 15th
September 2023.

 

You have requested the following information under the provisions of the
Freedom of Information Act 2000:

Please could you provide a copy of the event management plan that the
organisers of Reading Festival are required to submit to the council in
line with their premises license.

 

Our response is as follows:

Unfortunately we are unable to provide such sensitive information as set
out in the sections of the Freedom of Information Act 2000.

Section 43(2) says that information is exempt if its disclosure under FOIA
would, or would be likely to, prejudice the commercial interests of any
legal person (including the public authority holding it). This information
could provide sensitive information to other companies who may then look
to compete for contracts in this area of provision.

Section 40 – personal information also applies as names and contact
details for emergency responders is contained. Details of individuals
could be disclosed in the process of providing such sensitive information.

Section 38 – Health & Safety. Providing such sensitive information could
undermine the emergency plans in place to deal with such emergencies.

On the Reading Borough Council Website there is a publication scheme where
you can [1]search previous Freedom of Information requests that have been
responded to, to locate an answer to a future FOI request.

If you are unhappy with this response to your request for information
under the Freedom of Information Act then you may ask for an internal
review. Please make a request in writing to the Information Governance

I am writing to request an internal review of Reading Borough Council's handling of my FOI request 'Reading Festival Event Management Plan 2023'.

In relation to Section 43(2): You have cited the likelihood of prejudice to a third party's concerns, but you have not consulted this third party. As you may be aware, ICO guidance states "When a public authority wants to withhold information on the basis that to disclose the information would or would be likely to prejudice the commercial interests of a third party, it must have evidence that this does in fact represent the concerns of that third party. It is not sufficient for the public authority to speculate on the prejudice which may be caused to the third party by the disclosure."

In relation to Section 40: Please review this decision, as I believe the exemption has been applied wrongly. Note that I am not requesting personal information. Personal information can be redacted.

In relation to all sections: I believe that the exemptions you have applied refers to some, but not all, of the information I requested. Therefore I am requesting an internal review of your previous response and, should the exemption be upheld, would be grateful if you could provide the rest of the information, in a redacted fashion.
