I, Ismail Abdulhai Bhamjee do hereby make a request where the Metropolitan Borough Council had appealed in the Upper Tribunal CH/2093/2016 before the Upper Tribunal Judge Poynter where the Local Authority's Appeal had been allowed.

1. I would like you to provide me with a copy of the Law Report which you had relied upon the case of Watson V Winch [1916] 1 KB 688. Since this Law Report is for more than 60 years which is no longer Exempt information.

2. I would like to know the amount of the Costs in the Upper Tribunal if you had instructed the Barrister or outside firm of Solicitor.

3. Do you allow persons with the Right to Appeal to the Valuation Tribunal under Section 13A of the Local Government Act 1992 (As inserted under the 2012) Act since there is One Claim for Housing Benefit and Council Tax Reduction whilst there are two Appeals to be made, whilst the First Tier Tribunal and the Valuation Tribunal does not list the Appeals until the Local Authority have notified the Tribunal.

4. Does the Council makes an Award for compensation for Mal-administration without going to the Local Government Ombudsman. If compensation has been awarded the amount of Compensation during the past 12 Months.

I refer to the Freedom of Information Act 2000 and to your email to this
service dated 17th October 2017.

In accordance with the Freedom of Information Act, we are able to grant
access to the records requested and accordingly they are as follows:

1. I would like you to provide me with a copy of the Law Report which you
had relied upon the case of Watson V Winch [1916] 1 KB 688. Since this Law
Report is for more than 60 years which is no longer Exempt information.

We do not hold copies of case law. You would have to get that information
from a legal search engine such as Bailli.

2. I would like to know the amount of the Costs in the Upper Tribunal if
you had instructed the Barrister or outside firm of Solicitor.

We did not use external lawyers in relation to this case.

3. Do you allow persons with the Right to Appeal to the Valuation Tribunal
under Section 13A of the Local Government Act 1992 (As inserted under the
2012) Act since there is One Claim for Housing Benefit and Council Tax
Reduction whilst there are two Appeals to be made, whilst the First Tier

The Housing Benefit legislation states that any Housing Benefit claimant
has the right to appeal a decision made by the Local Authority.

I am writing to request an internal review of Gateshead Metropolitan Borough Council's handling of my FOI request 'RE:- WATSON V WINCH [1916] 1 KB688 AND COSTS in the Upper Tribunal [2017] UKUT 0041 (AAC) and Appeal to the Valuation Tribunal on Council Tax Reduction'.

I believe that you do have the List of Authority of Watson V Winch [1916] 1 KB688 which you had relied upon whilst this judgment has not been published on the Bailii Web Site. I therefore had to contact your Office.

I believe that you have not answered as with regards to the Council Tax Reduction Appeal as this has to be made to the Valuation Tribunal. There are two Tribunals.

I request your attention that there is a legal right to make an Application to the High Court Judge or the County Court for a Disclosure Order under the CPR 31 Rules, as when there is an Appeal before the First Tier Tribunal than a person can make a request to any other person who is not a party to the Proceedings, Since you had quoted the decision of Watson V Winch case in the Upper Tribunal, I see no valid reasons for refusal to provide me with a copy of the decision, where I wanted to place the decision before the High Court Judge and also the First Tier Tribunal.

I, Ismail Bhamjee request your attention and consideration that:-

1) The Section 42 of the Senior Courts Act 1981 Orders made on the 31st July 2003 and 8th December 2003 in the CO/3208/2003 Proceedings Between HM Attorney General versus Ismail Abdulhai Bhamjee is a Civil Proceedings Restraint Order against Ismail Abdulhai Bhamjee only, where it does not restrict from taking any Criminal Proceedings. My Wife Mrs Sahera Bhamjee and Associated Persons Brothers and Sisters, Nephews and Nieces were not added as parties to the Proceedings. There is a Legal Right also under the Criminal Procedure Rules for a Disclosure Order.

2) I understand that your Council had appeared in the Upper Tribunal where you had quoted the decision of Watson Versus Winch [1916] 1 kb 688. You do have the List of Authority.

3) The Bailii Web Site does not publish all the decisions made before any Court or Tribunal as they choose which Judgment they should publish. If the decision was published than I would not have requested your Office for the list of Authority, But I would have made a request that you provide me with copies of all the submissions made by the Council to the Upper Tribunal.

4) I have been directly or Indirectly been Discrimination under the Convention Treaties and International Treaties signed at the United Nations General Assembly, where the Chief Executive of the Borough Council should be informed.

5) There are many Lawyers-Barristers in the United Kingdom and Europe who have not taken into consideration of the Courts and Legal Services Act 1990 Section 11, 27 (7) and 119 this has caused miscarriage of Justice in the United Kingdom against many Citizens.

6) The Local Authorities does not have the Jurisdiction Power as with regards to complaints against Solicitors and Barristers as there are two separate Organisation Bodies. Duty not to mislead the Court.

7) I believe that you are not authorized to represent the HM Attorney General, and also the Secretary of State for Housing, Communities and Local Government, as I am aware where to serve the papers on the Government Legal Services Department, as under the CPR 19-4A A Minister of the Crown can be added as a Party to the Proceedings.
