I am writing to request an internal review of Westminster City Council's handling of my FOI request 'Rates: Church of Scientology Religious Education College Inc'.

My reason for requesting an internal review is:

I do not agree with the Council's application of the Section 41 (information provided in confidence) exception, because I do not agree that the information was provided in confidence.

It may be useful for you to know that the City of London Corporation has already provided a copy of the application form for Mandatory Relief in respect of another address - clearly the CoL does not believe that the Section 41 exemption applies here.

Thank you for your s dated 12th may, 10th July and 24th August 2009 regarding the response to your recent request to the Council (our ref: 3648).

In your s, you asked for an internal review of the handling of your Request. I have summarised the details of your appeal below:

I am sorry that you are dissatisfied with our handling of your requests and I have investigated your complaints under Stage 1 of the Council's Corporate Complaints Procedure. Further details of our procedure can be found on our website: http://www.westminster.gov.uk/services/c...

Response

Your original request to the Council was for a copy of the mandatory relief application form and related documentation for 42 Leinster Gardens. A response was provided on 12th May 2009 explaining that this information was no longer held by the Council, but that if it were still held, it would be likley to attract an exemption under Section 41 of the Act: Information provided in confidence. You wrote to the Council on 12th May 2009 requesting an internal review as you did not agree that the information was in fact covered by this exemption.

Having reviewed the response received and following discussions with the department concerned, I can confirm that this information is no longer held by the Council. As explained in Mr Black's response, this information has been disposed of in accordance with the department's retention policy.

As the documents concerned are no longer in existence, we cannot comment as to whether or not they would attract the exemption at Section 41: Information Provided in Confidence. Therefore your complaint with regards to the council's application of this exemption is partially upheld.

It should be noted that the refusal notice you received did state this information was no longer held. However, we do accept that this could have been made clearer. I apologise for any confusion this response may have caused.

This completes the internal review into the handling of your Request under the Council's complaints procedure. Should you be dissatisfied with our response, you are entitled to contact the Information Commissioner under Section 50 of the Freedom of Information Act.
