West Midlands Police did not have the information requested.

Dear West Midlands Police,
I am writing to you under the Freedom of Information Act 2000 to request the following information in regards to rapes of LGBT people in the West Midlands. I would like to know:
1. How many rapes of LGBT victims have taken place each tax year since 2014/15?
2. Categorised by gender of the offender and the victim? (Incl trans men and women)
3. The age of the victim.
4. Related to the attacker or not?
Please provide the above information digitally, preferably in the form of an excel spreadsheet.
If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under your Section 16 obligations, as to how I can refine my request to be included in the scope of the Act.
In any case, if you can identify ways that my request could be refined please provide further advice and assistance to indicate this.
I look forward to your response within 20 working days, as stipulated by the Act.

REQUEST

 

I am writing to you under the Freedom of Information Act 2000 to request
the following information in regards to rapes of LGBT people in the West
Midlands. I would like to know:

RESPONSE

 

Our data are not organised in such a way as to allow us to provide this
information within the appropriate (cost) limit within the Freedom of
Information (FOI) Act (see ‘Reason for Decision’ below).

 

However rather than refusing your request outright at this stage, I would
like to explore with you how West Midlands Police may best assist you to
request relevant information which we hold. Within the cost limit we could
search for crimes where a hate strand of homophobic or transphobic was
applied, as there is no specific grouping for LGBT.

 

Please note that any located information might be subject to the
application of exemptions under the Act.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to undertake the search outlined above. After
receiving your reply, your request will be considered and you will receive
a response within the statutory timescale of 20 working days, as defined
by the Act, subject to the application of any statutory exemptions. If you
chose not to respond then your request will remain unanswered.

 

REASON FOR DECISION

 

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12).  We do not have a recording category to
denote sexuality.

 

The cost of compliance with the whole of your request is above the amount
to which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12(1) of the FOI Act 2000. For West Midlands Police, the
appropriate limit is set at £450, as prescribed by the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004, S.I. 3244.
