Rank equivalencies for civil staff positions
Dear Northumbria Police,
The law and Police Regulations contain references to the relevant authorities in relation to the rank of the individual accused of the offence.
For instance the Statutory guidance issued by the IOPC defines one of the relevant process is only applicable if the alleged offender is over the rank of Chief Superintendent.
Unfortunately a significant number of decisions within your administration appear to be filled with civil staff i.e. not police officers and therefore not easily identifiable in relation to the police rank structure.
Please therefore provide a list of all the positions held by non police ranked employees i.e. civil staff and list their police rank equivalent to their position.
The intent is to establish the relevant rank for civil staff in relation to the police complaint regulations.

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')
Thank you for your email dated 20 January 2021 in which you made a request
for access to certain information which may be held by Northumbria Police.
As you may be aware the purpose of the Act is to allow a general right of
access to information held at the time of a request, by a Public Authority
(including the Police), subject to certain limitations and exemptions.
You asked:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.
No info held. We do not do a rank / grade comparison for the purposes of
Police Complaint regulations. When dealing with complaints we follow
guidance that states that someone suitable should be selected to deal with
the complaint.
Due to the different methods of recording information across 43 forces, a
specific response from one constabulary should not be seen as an
indication of what information could be supplied (within cost) by another.
Systems used for recording these figures are not generic, nor are the
procedures used locally in capturing the data. For this reason responses
between forces may differ, and should not be used for comparative
purposes.
The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must be
strictly in accordance with the Copyright Designs and Patents Act 1988 (as
amended) or such other applicable legislation. In particular, you must not

How to complain

Dear Northumbria Police,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Northumbria Police's handling of my FOI request 'Rank equivalencies for civil staff positions'.
My request was "Please therefore provide a list of all the positions held by non police ranked employees i.e. civil staff and list their police rank equivalent to their position."
Mr Cleughs response was "No info held."
According to Mr Cleugh, Northumbria Police hold no information regarding the employment of and role title / position for any civil staff.
With no information identifying any civilian employees of Northumbria Police it is therefore not unexpected that there would be no police rank equivalent for positions that do not exist.
However, since I myself have spoken to and indeed received communication from individuals identifying themselves as representatives of Northumbria Police without actually being police officers, such as Mr Michael Cleugh Data Protection and Disclosure Advisor as an example, I must therefore assume that Mr Cleugh has falsified a response under the FOIA to deliberately withhold information in breach of section 77 of the FOIA.
Since an offence under section 77 of the FOIA is a breach of UK Law, and the CPS identifies perverting the course of justice as "The course of justice starts when: an event has occurred, from which it can reasonably be expected that an investigation will follow"
My FOIA request was the event, which the law required that Northumbria Police must locate any such information and produce that information within 20 working days, in this case on or before the 17 February.
Northumbria Police exceeded the allotted time by law to produce a response claiming that no information is held, which is patently untrue as Mr Cleugh is one staff member identifying as "Civil Staff" within Northumbria Police claiming that Northumbria Police hold no records of his employment.
Mr Cleughs actions in this matter I believe, constitute a deliberate attempt to pervert the course of justice and show a continuing course of conduct intended to discriminate and harass in a vexatious manner whilst representing Northumbria Police.
Please record this as a formal allegation against Northumbria Police and also as a request for internal review.

I must ask you to clarify your request for review.
To confirm where you have stated -
“According to Mr Cleugh, Northumbria Police hold no information regarding
the employment of and role title / position for any civil staff.”
Can you please point out where I have stated this in my original response.
I believe I advised that there is not an Officer rank equivalent for every
civilian role.
I did not state that there is no role title /position for any civil staff.
Hopefully this clarifies the original response, however should you still
require formal internal review, can you please confirm this by reply.

Dear Mr Cleugh
Please specify under which policy or procedure you are requesting information in relation to an internal review request when you were the original member of staff involved in the response?
The internal review is to be undertaken by a member of staff not involved in the original decision, the very fact that you are making further requests is an apparent abuse of authority in breach of the requirements specified.
Please register this as a formal complaint of abuse of authority and vexatious behaviour intended to harass.
I will await contact by the member of staff undertaking the internal review in the meantime.
