Dear Rupert Burgess 

 

Thank you for your request for information, which was received on 23 May
2017. You requested RAISEonline data for Fulford School, Archbishop
Holgate's School and Huntington School (all in York).  I have dealt with
your request under the Freedom of Information Act 2000 (“the Act”).

A copy of the information is enclosed (because of the file sizes the 2
other reports will be in a separate email). You will note that some data
has been redacted and these are being withheld because it may be possible
to identify individual if it is cross-referenced with other information
that may be available from other sources. The following exemption
therefore applies:

Section 40(2) of the Act.

Under Part 2 of section 40, personal data of a third party (who is not at
the same time the personal data of the applicant) will be exempt if its
disclosure to a member of the public would contravene any of the ‘data
protection principles’. I have considered whether any of the data
protection principles would be contravened and in this case, I consider
that it would be in breach of the first principle as it would be unfair to
the individuals concerned if this information were to be released. By
that, we mean the likely expectations of the data subject that his or her
information would not be disclosed to others and the effect which
disclosure would have on the data subject. Section 40(2) is an absolute
exemption and is not subject to the public interest test.

The information supplied to you continues to be protected by copyright.
You are free to use it for your own purposes, including for private study
and non-commercial research, and for any other purpose authorised by an
exception in current copyright law. Documents (except photographs) can be
also used in the UK without requiring permission for the purposes of news
reporting. Any other re-use, for example commercial publication, would
require the permission of the copyright holder.
