We write further to your request for information under the Freedom of
Information Act received 26 November 2020. We have set out your request,
together with our response below.
I refer to your involvement with RAIR Health as documented in HTN.co.uk on
November 25 2020.
In relation to this processing, are you able to please provide a copy of:
(a) Any Data Protection Impact Assessment carried out in relation to this
arrangement
A Data Protection Impact Assessment has been carried out, however under
Section 43 (2) of the Freedom of Information Act which states "information
is exempt information if its disclosure under the Act would, or would
likely to, prejudice the commercial interests of any person (including the
public authority holding it)” we are unable to provide you with this
information. The Trust feels that the disclosure of this information
would commercially prejudice the interests of the company and the Trust.
(b) A copy of the data items to be provided to RAIR
RAIR will be provided with access to anonymised patient data in the form
of digital ophthalmology images including retina scans. At no stage in the
project will the anonymised images be owned by RAIR and RAIR will have no
legal title to the anonymised images. At no stage in the project will RAIR
have access to, or be provided with, identifiable patient data. The Trust
cannot provide the actual data as it is confidential patient information,
held behind a firewall.
(c) Whether in relation to clinical safety, if RAIR identifies a potential
clinical issue which had not previously been picked up, there is the
ability for RAIR to inform yourselves and for you to re-identify that
patient?
If RAIR identifies a potential clinical issue which had not previously
been picked up, there is the ability for RAIR to inform the Trust but RAIR
itself would not be able to re-identify that patient. The data that RAIR
will have access to will be anonymised and the key to that data will be
held by UHCW only and will not be available to RAIR.
As we have provided the information that we do hold your request is now
closed. We trust that this is satisfactory but if you are dissatisfied
with the way that it has been handled you have the right to ask for an
internal review. Internal review requests should be submitted within two
months of the date of receipt of the response to your original letter and
should be addressed to: David Walsh, Director of Corporate Affairs,

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of University Hospitals Coventry and Warwickshire NHS Trust's handling of my FOI request 'RAIR Health'.
I am not sure I understand how the entire DPIA is commercially sensitive? It is very common practice to publish DPIAs (see NHS England for a number of their projects for example). Please could you provide me with a redacted version where you remove any information with is commerically sensitive. I can't see how details of how you communicate the processing to data subjects (as one parte of a DPIA) would be commercially sensitive, so would expect you to provide details such as this.
Regarding the data itself, could you confirm the data schema that is provided to RAIR, along with the arrangement that has been signed with yourselves and RAIR? I don't need any commercially sensitive information such as a money exchanged, so feel free to remove this. Any data processing clauses woudl of course not be commerically sensitive and again shoudl be published (See NHS England approach).
