Dear Requestor

 

Thank you for your FOI requests which have been submitted as separate
email requests (5^th January 2024 and 13^th January 2024)

 

When a public authority receives more than two requests in a period of 60
consecutive working days from the same requestor these can be aggregated
if the topic or subject matter of the request is the same or similar. This
is documented under Section 12 (4) of the FOI Act which states “The
Secretary of State may by regulations provided that, in such circumstances
as may be prescribed, where two or more requests for information are made
to a public authority-

 a. By one person, or
 b. By different persons who appear to the public authority to be acting
in concert or in pursuance of a campaign, the estimated cost of
complying with any of the requests is to be taken to be estimated
total costs of complying with all of them.

In addition to the above, you have now submitted two further requests that
relate to the same or similar topics, therefore, these will be treated as
one request and any subsequent requests for information (which meets the
aggregation criteria) within 60 consecutive working days will be dealt
with under this one reference. Due to the volume of information you have
requested, we will now begin to review each question and confirm out of
this information those that we will be able to provide a response to
within the 18 hours appropriate time limit set under the Freedom of
Information Act. As part of this calculation we will seek clarification
from staff involved in your previous requests to ascertain the amount of
time already currently taken to respond to your previous requests.

 

Once this review is complete, we will confirm either a response to the

Does the Trust have a public-facing policy or statement that bans
biphobic, homophobic and transphobic discrimination in its services?

No.

 

Does the Trust have an employee policy (or statement within an employee
handbook) that includes the following?

Explicit ban on discrimination, bullying and harassment based on sexual
orientation Yes

 

Explicit ban on discrimination, bullying and harassment based on gender
identity and gender Yes

 

Clear information about how to report an incident and how complaints are
handled Yes

 

Handbook:

“We have a statement in the handbook that “everyone who works for us, uses
our services and provides care for our service-users can expect respect”

On p44 there is signposting to the Resolution and Disciplinary Policy. 
The words discrimination, bullying and harassment do not appear, and we do
not explicitly mention sexual orientation, gender identity or gender. 

 

Policy:

The Dignity and Respect in the Workplace Policy features information on
how to report incidents and raise complaints, including a flow process. 

 

“Any conduct based on age, gender [sex], pregnancy or maternity, marriage
or civil partnership, sexual orientation, gender reassignment, disability,
HIV status, race, religion, or belief political, trades union or other
opinion, national or social origin, association with a minority, domestic
circumstances, property, birth or other status which is unreciprocated or
unwanted and which affects the dignity of men and women at work” (NHS
Terms and Conditions of Service Handbook).”

 

We have attached all relevant policies in this response.

 

Please also note we are unable to provide the information requested in its
entirety: the Rainbow Badge audit also comprises surveys on electronic
forms which staff input into directly and the Trust does not have access
to the submissions made.

The equality policy is on page 120 of the policies bundle disclosed - HRP013 Promoting Equality, Diversity and Inclusion. It incorrectly uses gender [sex] as the protected characteristic and uses gender where it should use sex in other policies including the search policy.
