Dear NHS Highland,

While I wait for your Scottish Information Commissioner's Office to commence investigating my previous requests, submitted more than a year ago, please provide:

1. Copies of all the recorded information required by your country's legislation and by your local partner Highland Council to run the Glen premises from 05 May 2022 onwards, including the:

• Fire Safety Scotland Act
• Annual Fire Risk Assessment
• 5 Yearly Electrical Inspection
• Annual PAT testing
• CNORRIS Indemnity Insurance
• Annual Heating Inspection
• Annual Door/Windows Inspection
• 3 Monthly Legionnaire Inspections
• Emergency Lighting Checks
• Fire Equipment Testing
• Quarterly Electrical Installation Safety Checks

For the Financial Year 2023-2024, please provide:

2. Copies of the rent increase letters issued to residents.

3. Copies of the Rent Increase Notices issued to residents (as required by the Private Housing (Tenancies) (Scotland) Act 2016 and by the Cost of Living (Tenant Protection) (Scotland) Act 2022 enacted by your Scottish Parliament).

4. A detailed breakdown of all the charges and rental charges applied in every premises.

5. Full name, job position and pay band (including bonuses, awards, benefits, donations, gifts, expenses, allowances and any other contributions that they have received on top of their salaries) of the individuals within and outwith your organization involved in the decisions, processes and identification of criteria regarding the charges and rental charges that must be imposed and taken out of residents' pockets and how to use that money.

According to the amount of money taken from some residents' pockets, your organization has a potential annual income of at least £142,887.04 from the Glen premises.

For the Financial Year 2022-2023, please provide:

6. A detailed list of the works and costs that were carried out in the Glen premises, including those carried out by external contractors and copies of the Maximo Report Works by External Contractors from 05 May 2022 onwards.

Your staff should be monitored and assessed for competencies and compliance regularly.

Please provide:

7. A detailed description of the responsibilities and competencies (including the legal responsibilities and competencies) of your HR performance and systems manager, accommodation manager, head of people services, payroll manager and facilities/security manager and to whom they are accountable and to whom they have to report.

8. Full name and job position of the individuals that monitored and assessed your HR performance and systems manager, accommodation manager, head of people services, payroll manager and facilities/security manager in the years 2018, 2019, 2020, 2021 and 2022 and the outcome of the monitoring and assessments.

9. A copy of the formal definitions of gross misconduct and harassment currently in use in your organization, including the date, full name and job position of the individuals that wrote and introduced those definitions.

10. Unredacted copies of all the recorded information available in relation to the need to amend the formal definitions of gross misconduct and harassment that were previously in use in your organization.

I am not sure if I understand your request for clarity. 

Question 8 is the continuation of Question 7. Once you have gathered the information requested in Question 7, Question 8 should become clear. 

For example:

It is presumed that your staff have the competencies, including the legal competencies, required to carry out the jobs for which they are being well paid. As a consequence, your staff is presumed to be responsible, including legally responsible, for the work they are being well paid to carry out.

Thus:

Who checked and appraised (”monitored and assessed”) the work carried out by the staff mentioned in Question 8? 

What was the outcome of the checking and appraisal ("monitoring and assessments") of the staff mentioned in Question 8? Is there a record of the checking and appraisal? What was written in it and who wrote it?

For example:

In one of the claims (Mr Sergio Sabato v Highland Health Board: 4107180/2019) lodged by Mr. Sabato in your EMPLOYMENT TRIBUNALS (SCOTLAND), Mr. Sabato emphasised to the Employment Judge that despite the National Minimum Wage investigation carried out by the HM Revenue & Customs (an investigation that commenced following a Formal Complaint raised to the HM Revenue & Customs by Mr. Sabato, a fact that does not appear of having been included by your Employment Judge in the Judgment of 15 October 2019), Highland Health Board still refused to pay the National Minimum Wage to Mr. Sabato (a criminal offence that led to further claims by Mr. Sabato).

Of the people from Highland Health Board that were present at the EMPLOYMENT TRIBUNALS (SCOTLAND) hearing of 10 October 2019, your HR performance and systems manager and accommodation manager were those heard by the Employment Judge.

Knowing the outcome of the National Minimum Wage investigations (which followed the Formal Complaints raised by Mr. Sabato) carried out by HM Revenue & Customs down in England and of the claims lodged by Mr. Sabato in your EMPLOYMENT TRIBUNALS (SCOTLAND):

Who checked and appraised (”monitored and assessed”) the work carried out by the staff mentioned in Question 8?

What was the outcome of the checking and appraisal ("monitoring and assessments") of the staff mentioned in Question 8 in the years 2018, 2019, 2020, 2021 and 2022?

I am writing to request an internal review of Highland NHS Board's handling of my FOI request 'Raigmore Hospital Staff Accommodation 31'.

Question 1:

I cannot find​ the​ "3 Monthly Legionnaire Inspections" in the documents released by your organization.

If the "3 Monthly Legionnaire Inspections" ​is still a legal requirement in your country, could you please provide a cop​y​ of it?

Question 3:

I cannot find the "Copies of the Rent Increase Notices issued to residents (as required by the Private Housing (Tenancies) (Scotland) Act 2016 and by the Cost of Living (Tenant Protection) (Scotland) Act 2022 enacted by your Scottish Parliament)"​ in the documents released by your organization.

​Could you please provide copies of those documents?​

According to legislation enacted by your Scottish Parliament, there appears to be a legal procedure to be followed for rental increases. A legal procedure that your very well​ ​paid staff should be aware of.

For example:

The letter issued to residents by your mate Maggie is dated 6th April 2023. The rent increase enforced on residents by your organization was introduced six days earlier, on 1st April 2023, and was certainly not the 3% CAP indicated by your country's legislation;​​ also the letter dated ​2nd February 2023​ does not appear to adhere to your country's legislation.​

(​Shouldn't your organization enforce page 3 of your​ ​"Conduct Policy: guide to expected standards of behaviour"​ on some of its staff in these circumstances?​)

Question 5:

Besides your "NHS Highland Board members’ Register of Interests 1 April 2023 – 31 March 2024" (access to ​"​NHSH Register of Interest Board Members 2022-23​" ​searched ​on your website is ​denied​), I cannot find the "Full name, job position and pay band (including bonuses, awards, benefits, donations, gifts, expenses, allowances and any other contributions that they have received on top of their salaries) of the individuals within and outwith your organization involved in the decisions, processes and identification of criteria regarding the charges and rental charges that must be imposed and taken out of residents' pockets and how to use that money."

From 05 May 2022 to 12 May 2023, your organization has reinvested in the Glen premises just over 2% of the potential annual income of £142,887.04. Money taken out of residents' pockets in order to maximise the income of the NHS Highland Board.

Please release the information requested in Question 5 regarding the individuals in your Estates Facilities, Capital Planning Directorate, Asset Management Group and Board members.

Question 8:

​It appears that page 3 of your "Conduct Policy: guide to expected standards of behaviour"​​ was developed nationally by your​ NHS Scotland employers, ​your ​trade unions and your​ Scottish Government​ and is supposed ​to be followed by all your Boards, including your organization.

This means that:

Knowing the outcome of the National Minimum Wage investigations carried out by HM Revenue & Customs down in England, the outcome of the claims lodged in your EMPLOYMENT TRIBUNALS (SCOTLAND) and of the Formal Complaints raised (and ignored) to your organization regarding assaults, persistent vandalization and smearing with faeces of personal belongings ​(​within your premises under CCTV surveillance and in areas only accessible to your staff​) ​and the persistent destruction of the evidence (for example, CCTV recordings) required for the eventual investigations, ​please​ provide ​​"Full name and job position of the individuals that monitored and assessed your HR performance and systems manager, accommodation manager, head of people services, payroll manager and facilities/security manager in the years 2018, 2019, 2020, 2021 and 2022 and the outcome of the monitoring and assessments."

(According to the response given to Question 7, your s​ecurity manager has to report to your facilities manager. This means that your mate Crawford has to report to himself. Unbelievable!)

Dear NHS Highland Board,

I did not expect much from the outcome of your internal review. (No matter what, mates stick together.)

I will contact again your Scottish Information Commissioner's Office to see when they plan to publish what they have to tell me. (They've already told me that they will refuse to publish my name (Mr. Sergio Sabato). Despite having previously reminded me that they themselves have to respond to FOISA requests they receive. For example, requests asking them to disclose my name. And that is what I have requested them to do. To disclose my name. Request refused!)

But before contacting your Scottish Information Commissioner's Office (nominated and paid by the elected representatives of your people), there is a piece of recorded information released by your organization on 2 June 2023 that needs to be clarified:

The "main door damaged, requires to be sanded down" that your organization has recorded with the euphemism "damaged", is a vandalized door with racist words carved into it.

The vandalization of that door, with racist words carved into it, was reported by Mr. Sabato to your accommodation manager (she laughed) and your other mates (all receiving salaries paid by the taxpayers) at your accommodation office in 2007 (in the same days when the tax-paying foreigners staying in the Glen premises were "suggested" by your publicly financed organization to go back to their country of origin). 

And after 16 years, your organization has yet to sand down that door. 

This is a further confirmation of the ingrained culture of your people.
